Johnson, Liquor Commissioner James P. Petri, Commission Member Samuel L. Lissner, Commission Member ALSO PRESENT: George B. Knickerbocker, Village Attorney Patricia S. Smith, Village Clerk James Lancaster, Police Officer Gina Nunes, Court Reporter President Johnson called the hearing to order at 6 :35 p.m. Ms. Nunes swore in Police Officer James Lancaster, Linda Clucas, owner of Pope' s Pub and Barbara Gennardo, bartender at Pope' s Pub, 66 E. Devon Avenue, Elk Grove Village, IL. Officer Lancaster testified as to the incident of May 20, 1999 when Barbara Gennardo an employee of Pope' s Pub sold beer to a confidential informant whom is under the age of 21. The informant did not show nor did he have any means of identification which would have given an age of 21 years or older. The testimony of Officer Lancaster, Linda Clucas and Barbara Gennardo is contained within the court reporter' s transcript which is attached hereto and made a part hereof. Ms . Nunes swore in Patricia Geraci, owner of J.G. 's Sports Bar, 1000 E. Higgins Road, Elk Grove Village, IL 60007. Officer Lancaster testified as to the incident of May 20, 1999 when an employee of J.G. ' s Sports Bar sold beer to a confidential informant who is under the age of 21. The informant did not show nor did he have any means of identification which would have given an age of 21 years or older. The testimony of Officer Lancaster and Patricia Geraci is contained within the court reporter' s transcript which is attached hereto and made a part hereof . Ms. Nunes swore in Terrence W. Bieze, owner of Buster' s Billiards and Valerie A. Olechny, waitress of Buster' s Billiards, 2801-F Touhy Avenue, Elk Grove Village, IL 60007 . Officer Lancaster testified as to the incident of April 22, 1999 when an employee of Buster' s Billiards, sold beer to a confidential informant who is under the age of 21. The informant did not show nor did he have any means of identification which would have given an age of 21 years or older. The testimony of Officer Lancaster, Mr. Bieze and the employee, Valerie Olechny is contained within the court reporter' s transcript which is attached hereto and made a part hereof. Upon hearing the testimony given, the Liquor Commission adjourned to deliberate in closed session. When the Commission returned to open session, the Liquor Commissioner admonished the owners of the seriousness of the incidents. Commissioner Johnson then announced that a fine of $250 . 00 payable within ten (10) days and one third (1/3) of the court reporter' s fees was being imposed upon Linda Clucas, Pope's Pub and Terrence Bieze, Buster' s Billiards plus one-third of the cost of the Court Reporter fee. Mrs . Clucas and Mr. Bieze were informed that the Commission took into consideration the fact that they have taken steps to reduce the opportunity for this to happen again. The commissioner impressed upon Ms. Geraci the seriousness of the incident and also noted that the person behind the bar who stated that he was the owner riled the patrons in the bar who harassed the Police Officers . A fine of $500 . 00 payable within ten (10) days was imposed upon Patricia Geraci, J.G. ' s Sports Bar, plus one-third of the Court Reporter fee. The Liquor Commissioner emphasized the fact that the Village operates with a zero tolerance with regard to the sale of liquor to minors and wanted it to be known that the first offence will result in a fine and the second offense will rate a suspension of liquor licenses.
