Johnson, Liquor Commissioner Trustee James P. Petri, Commission Member Trustee Samuel L. Lissner, Commission Member ALSO PRESENT: George B. Knickerbocker, village Attorney Ann I . Walsh, Village Clerk Gina Nunes, Court Reporter Mr. Mahesh Patel Mr. Sandip Patel President Johnson called the hearing to order at 6 :35 p.m. It was noted for the record that the public hearing before the Liquor Commission is meeting to consider evidence concerning the violation of the requirement of having the proposed manager present himself to be interviewed by the Elk Grove Police Department for necessary background investigation which is a condition on the issuance of the liquor license under the new ownership at Sunny Liquors, 1067 Rohlwing Road, Elk Grove Village, IL. Ms. Nunes swore in Sandip Patel and Mahesh Patel as witnesses herein. President Johnson presented a series of events that have occurred with the Sunny Liquor location over the past couple of years including (1) a public hearing for selling liquor to a minor which resulted in a fine for the violation; (2) a meeting at which President Johnson was led to believe the gentleman accompanying Sunny Patel was Mahesh Patel when actually it was Sandip Patel; and (3) the fact_ that Sandip Patel has not provided the proper documentation for a complete and thorough background check by the Police Department despite numerous attempts by the Police Department to make an appointment with Sandip. Testimony of Mahesh and Sandip Patel is contained within the court reporters transcript which is attached hereto and made a part thereof. Upon hearing the testimony given, the Liquor Commission adjourned to deliberate in closed session. When the Commission returned to open session, the Liquor Commissioner admonished the owners of the seriousness of the incidents. Commissioner Johnson read an official finding of fact stating the Liquor Commissioner ordered that the Liquor License No. 6735 be revoked. The Liquor Commission entertained a motion by the respondent to reconsider the finding and the decision to revoke the license, the motion to be entered and the hearing on the motion to be continued for 21 days (November 16, 1999 at 7 : 15 p.m. ) Until said date, the license shall be revoked and the premises closed as of 6 :00 p.m. Tuesday, October 26, 1999 . Mr. Mahesh was instructed to return and to have a person managing the store that has been satisfactorily investigated by the Police Department and approved by the Liquor Commissioner.
