HomeMy WebLinkAboutLIQUOR COMMISSION - 02/03/2000 - HALL OF FAME ELK GROVE VILLAGE LIQUOR COMMISSION PUBLIC REHEARING HALL OF FAME BILLIARDS FEBRUARY 3 , 2000 CHERNICK CONFERENCE ROOM PRESENT: Craig B. Johnson, Liquor Commissioner George B. Knickerbocker, Village Attorney Ann I . Walsh, Village Clerk Gina Nunes, Court Reporter President Johnson called the hearing to order at 3 :30 p.m. and stated for the record the rehearing is limited to reconsideration of the sanctions imposed on the licensee: suspension for a period of seven (7) days; and payment of a $750 . 00 fine plus one-sixth of the court reporter' s fees . In addition, the rehearing will be conducted solely before the Liquor Commissioner, President Craig B. Johnson; the presence of the Advisory Members of the Commission being waived. Ms Nunes swore in Richard Herbert and Edward Lipsky as witnesses herein. Dr. Richard Herbert and Attorney Edward Lipsky presented their request for amendment to the sanctions as listed above and described measures now being enforced for the training and education of staff regarding the procedures for obtaining proper ID when serving alcohol . Testimony and examination included matters related to past violations, ownership of Hall of Fame, and the reasons for the respondent' s request for a rehearing. A complete testimony of Hall of Fame is contained in the court reporter' s transcript attached hereto and made a part hereof . Upon hearing the testimony given, the Liquor Commission and Village Attorney adjourned to deliberate in closed session. When the Commissioner returned to open session, the Liquor Commissioner stressed his resolve to take every step possible to make sure the sale of liquor to minors in Elk Grove Village does not occur. At this time the Liquor Commissioner announced the following amended Findings and Order: 1 . The initial fine of $750 .00 plus one-sixth the cost of Court Reporters fees for the January 20, 2000 public hearing will remain the same. 2 . The Respondent shall pay the cost of the Court Reporter fees for the rehearing on February 3, 2000; 3 . The seven day suspension of the Hall of Fame liquor License for seven (7) days be amended and shall be for a period of four (4) days commencing Tuesday, February 8, 2000 through Friday February 11, 2000 .
