Johnson, Liquor Commissioner Trustee James P. Petri, Commission Member Trustee Samuel L. Lissner, Commission Member ALSO PRESENT: Village Clerk Ann I . Walsh Village Attorney George B. Knickerbocker Police Officer Eric Perkins Jitendra K. Patel Rakeshkumar D. Patel Sunny Liquors - 1067 Rohlwing Road Liquor Commissioner Johnson called the public hearing to order at 6 :32 p.m. Mr. Jitendra K. Patel, owner, Rakeshkumar D. Patel, store clerk, and Elk Grove Police Officer Perkins were called as witnesses and duly sworn-in. Officer Medina gave testimony that on the night of Friday, July 28, 2000 at approximately 9 :00 p.m. he observed a vehicle parked outside Sunny Liquors occupied by persons looking younger than 21 years of age. At that time, he also observed a young looking gentleman who appeared to be under the age of 21 standing in line at Sunny Liquors and holding a bottle of beer. The minor purchased the beer and was approached by Officer Perkins who identified himself as an Elk Grove Police Officer. The young man advised officer Perkins he was actually 18 years old and that he did in fact purchase a 40 ounce bottle of Budweiser beer without showing identification to the store clerk. Officer Perkins then placed the minor and store clerk under arrest. The clerk indicated he did not ask for proof of ID and that he thought he knew the customer. Officer Perkins stated that an inventory of the mans personal property did not produce evidence of a fake ID. Store clerk Rakeshkumar Patel responded to questions of the Liquor Commission and stated he did in fact sell liquor to the minor. Liquor Commission Public Hearing 2 September 12, 2000 Jitendra Patel, owner of Sunny Liquors, apologized to the Liquor Commission and stated he has posted signs at his store that ID is required and will be carding all customers now. The complete testimony of Officer Perkins, Rakeshkumar Patel and Jitendra Patel is contained within the court reporter's transcript on file in the Village Clerk's Office. At this time, Ms. Holly Kuhns, 1579 California Street, approached the Commission. Ms. Kuhns, parent of the arrested minor, stated that it has been said that two high schools in the area have been buying alcohol at Sunny's Liquors the entire summer and asked that this fact be part of the public record. Upon hearing the testimony, the Liquor Commission adjourned to deliberate in closed session. (6 :55 p.m. ) The Commission returned to open. session at 7:00 p.m. Liquor Commissioner Johnson admonished the owner (Jitendra Patel) and reminded him of the warnings and conversation that took place regarding sale of alcohol to minors when Mr. Patel initially applied for a liquor license as new owner of Sunny Liquors . The Liquor Commissioner also noted there's got to be parental responsibility involved and parents should make sure kids don't want to go out and try to get liquor either legally or illegally. The Liquor Commissioner then imposed the following fines and orders : Suspension of Liquor License for one (1) day-Friday, September 29, 2000. Respondent shall pay a fine in the amount of five hundred dollars ($500 .00) plus Court Reporter fees for the hearing.
