Walsh Police Officer Keith Wilcox Margo Maple - Sun Drugs Manahar Patel - EZ Pantry Liquor Commissioner Johnson called the public hearing to order Tuesday, January 23, 2001 at 6 :00 p.m. and noted for the record that each respondent had received notice of the complaints. Pharmacy Consultants/Sun Drugs-548 Devon Avenue Ms. Margo Maple and Officer Wilcox were called as witnesses and duly sworn in. officer Keith Wilcox proceeded to give testimony that on the evening of December 19`", 2000, a 19 year old patron, as part of the Police Department sting, was successful in purchasing a six pack of Miller Light beer from Sun Drugs cashier, Mary Cohnke, without identification requested. Ms. Maple testified Sun Drugs has made provisions to purchase a cash register that requires the patron' s birth date be entered for all liquor or tobacco sales. Discussion ensued regarding the policies currently being practiced by Sun Drugs regarding sale of liquor and precautions being considered to avoid the sale of liquor to minors. The complete testimony of Ms. Margo Maple is contained within the court reporter' s transcript that is on file in the Village Clerk' s Office. Liquor Commission Public Hearing 2 January 23, 2001 EZ Pantry/Licruors Etc. 1113 Nerge Road. - Manahar Patel, owner of EI, Pantry/Liquors Etc. was called as a witness and duly sworn in. Officer Wilcox reported that on December 29, 2000 a 19 year old minor was allowed to purchase a six pack of alcoholic beer without being asked for identification by cashier, Ghanshyam Patel. Manahar Patel answered questions of the Commission and Village Attorney and related Mr. Ghanshyam Patel was fired following the incident. The owner also indicated an interest in the cash registers mentioned during Ms. Margo Maple' s testimony earlier. Mr. Patel related that during the year 2000 he had reported 7 incidences whereby he confiscated fake ID's which were sent either to the Elk Grove Police Department or the Illinois Secretary of State's Offices. The complete testimony of Officer Wilcox and Manahar Patel are contained within the court reporter's transcript on file in the Village Clerk's Office. Upon hearing the testimony, the Liquor Commission adjourned to deliberate in closed session. The Commission returned to open session at 6 :40 p.m. Liquor Commissioner Johnson stated for the record that the Police stings that took place before this December sting produced about a 35 percent failure rate. The December 2000 sting resulted in a failure rate of 18 percent. The Commission hopes for a zero percent failure rate from now on. The Liquor Commissioner then imposed the following fines and orders for Pharmacy Consultants/Sun Drugs and EZ Pantry/Liquors Etc. : Liquor commission Public Hearing 3 January 23, 2001 1. Suspension of liquor license for one (1) day (Wednesday, February 21, 2001. 2 . Respondents shall be assessed a fine in the amount of $500.00, the payment of which shall be stayed until July 1 2001. If the respondents install a computerized cash register that enables monitoring the age of the customers and proof of the installation is provided to the Village, the fine will be waived. 3 . Respondents shall pay the costs assessed to the respondent for the Court Reporter fee, with the fine to be paid within 10 days from the date a bill with the exact amount due is received. Liquor Commissioner Johnson noted for public record that both businesses have had two previous violations and a third violation for carding a person under the acre of 21 for purchase of alcohol will require revocation of the businesses liquor license. However, penalties for not carding someone 21 years old and over are addressed in the Ordinance that became effective January 1, 2001 . The public hearing was adjourned at 7 :45 p.m. Craig B.
