Higgins Road January 29, 2003 PRESENT: Liquor Commission Mayor Craig B. Johnson, Liquor Commissioner Trustee James P. Petri Trustee Samuel. L. Lissner ALSO PRESENT: George B. Knickerbocker, Village Attorney Ann I . Walsh, Village Clerk Mr. Koichi Yoshida Ms . Hiroko Kitazawa Mayor Johnson called the hearing to order at 7 :00 p.m. and noted for the record the public hearing was called to hear evidence concerning the sale of alcohol to minors at Kurumaya Restaurant, a Division of Maui Mark, Inc . , at 1201 E. Higgins Road, Elk Grove Village, Illinois and the possible suspension and revocation of liquor license at that establishment. Mr. Yoshida, identified as the Manager of Kurumaya, indicated the respondent had received notice for the hearing. Police Officer Michael Ryan, Koichi Yoshida and Hiroko Kitazawa were sworn in as witnesses herein. The Liquor Commissioner questioned Mr. Yoshida as to the ownership of the restaurant . During the course of the discussion it was revealed that ownership had changed in June 2002 from Mr. Hayashi to Mrs . Kitazawa. The Village was never notified of this change which is the responsibility of the owners . The restaurant was found to be in violation of the liquor ordinance since the new owners did not apply for a new liquor license in their name nor go through the required background check. Furthermore, the owner did not apply for a business license for that restaurant . A complete testimony of Mr. Yoshida is contained in the court reporter' s transcript attached hereto and made a part hereof. Police Officer Ryan gave testimony as to the circumstances leading to two underage informants being served alcohol at Kurumaya Restaurant. Upon hearing the testimony given, the Liquor Commission adjourned to deliberate in closed session. When the Commission returned to open session, the Liquor Commissioner ordered the liquor license be picked up at opening hours (11:30 a.m. ) on Thursday, January 30,2003 by the Police Department. The new owner was told to come into the Village hall the next morning and purchase a food and beverage license to allow for the serving of food and non-alcoholic beverages . Business would be allowed to operate but no liquor can be sold until the new owners go through the proper procedures. Following submission of a Liquor License application and an investigative background check by the Police Department, a meeting will be called with the owner, their counselor, the Village Attorney and the Liquor Commissioner to discuss the parameters of issuing a liquor license.
