Automatic Fire Department Aid Agreement with Des Plaines
The consensus of the Committee was to enter into a reciprocal automatic aid agreement with the City
of Des Plaines.
Smoking in Public Places
Following a lengthy discussion, the consensus of the Committee was to authorize the Village
Attorney to prepare an ordinance restricting smoking in the following places:
• All restaurants and bars except for outside seating, which must be 10' from door;
• Outdoor park area playgrounds, sports and recreational area bleachers when in the presence
of others;
• Carnival smoking prohibited;
• Rotary Fest, except in a segregated smoking area tent;
• Village Hometown Parade and Tour of Elk Grove Bike Race from sidewalk to sidewalk;
• Private businesses and clubs within ten feet (10') of the entrance door;
• In-Home Day Care facilities, when children are present;
• Taxicabs, limousines, and trolleys do not regulate;
• Hotels and motels, with the exception of 2.0% of their rooms which could be designated as
smoking rooms;
• Banquet halls, within ten feet(10') of the entrance door;
• Public buildings, within ten feet(10') of the entrance door
• Village Green/Memorial Park, no regulation;
• Nursing homes/long-term care; Village Staff will survey the facilities to determine if
smoking is permitted.
It was the consensus of the Committee that the proposed ordinance would take effect on March
1, 2007. In addition, fines for the violation of this ordinance would range from $25 to $500. A
first reading of the ordinance will be held on March 14, 2006.
Sale of Tobacco Products
It was the consensus of the Committee that a new license fee would be placed on establishments
that sell tobacco products. The consensus of the Committee was to establish a new fee structure
as follows:
• $5,000 for big box establishments, which exceed 9,000 square feet; and
• $1,000 for all other establishments that are less than 9,000 square feet.
Furthermore, it was the consensus of the Committee that all revenues received through the
licensing of tobacco would be earmarked to be used for smoking cessation programs. As part of
this, the Director of Health & Community Services will work with the Elk Grove Board of
Health to determine ways in which these funds can be used for smoking cessation programs.
This new fee structure would be enacted on June 1, 2006.
Ordinance will be presented for a I"Reading on 3/14/06.
