Clery,Attorney Secretary Geinosky called for a motion to name an Acting Chairman. Commissioner Meyers motioned to appoint Secretary Geinosky as Acting Chairman and Commissioner Paliganoff as Secretary. Commissioner Hemici seconded the motion. Upon voting(Geinosky,Hauser,Henrici, Sokolowski, Paliganoff,Thompson,Meyers, Ayers,AYES, Glass,ABSENT)the motion carried. Acting Chairman Geinosky called the meeting to order at 7:00 p.m. Item 1: August 16 Meeting Minutes Commissioner Meyers motioned to approve the meeting minutes. Commissioner Henrici seconded the motion. Upon voting(Geinosky,Hauser,Henrici, Sokolowski,Paliganoff,Thompson,Meyers,AYES, Ayers,ABSTAIN,Glass,ABSENT)the motion carried. Item 2: PC Docket#06-8: One 6 Motorsports—Special Use 610 Bennett Road Acting Chairman Geinosky read the petition into record. Secretary Paliganoff swore in the petitioners. J. Clery stated that the petitioner currently owns the building at 610 Bennett. He also noted that M.Johler is the owner and operator of One 6 Motorsports,which is a retailer and fabricator of performance automotive parts. J. Clery stated that One 6 Motorsports has been in operation for the past four(4)years,and prior to being in Elk Grove Village they were located in Arlington Heights. The reason behind the move to Elk Grove Village was so they could expand their operations. Their facility is approximately 5,000 square feet in size,with a rear parking area that measures sixty feet(60')in depth and seventy feet(70')in width. - 1 - J. Clery stated that there would be a total of three(3)employees and three(3)workstations. In addition, all vehicles will be parked inside the building in the evening. In regard to fluids,J. Clery noted that a licensed company would dispose of all fluids. J. Clery noted that following M. Johler's advisement of needing a Special Use permit to operate,M. Johler applied to the Village for the permit. J.Clery stated that M.Johler wants very much to be a part of the community and also wants to comply with all the Village ordinances. Acting Chairman Geinosky referenced a memo from A.Boffice,Director of Engineering&Community Development,noting prior issues that had arisen with the operations and that were currently pending in housing court. Acting Chairman Gemosky also referenced a memo from G.Knickerbocker,Village Attorney,which stated the issue was an administrative issue and that it was being dealt with internally. J. Clery stated that the issue in housing court is almost resolved,and he again reiterated that M.Johler wants to comply with all the Village ordinances. Commissioner Thompson stated that the memo from A.Boffice is disturbing. He stated that he could not understand how a business owner could operate without knowing all the municipal ordinances. M.Johler stated that when he was in Arlington Heights,everything that he was doing was acceptable under their zoning ordinance. He assumed the same held in Elk Grove Village. Commissioner Thompson asked if Engineering had reviewed the recently submitted parking plan. S. Trudan stated that they did not have time to fully review the revised parking plan. Commissioner Sokolowski asked if the petitioner had received a copy of the letter from the"Anonymous Neighbor." J. Clery stated that he received the letter the day before. Commissioner Sokolowski requested that the petitioner reply to the comments in the letter. J.Clery stated that he had no issues with his client answering the letter,but noted that it was unsigned and could easily be from one of his competitors. In regard to concerns about loud exhaust,Mr. Johler stated that he is a fabricator and retailer of performance exhaust systems and headers. In addition,he indicated that he is installing signage requesting his customers not to rev their engines. As for loitering teenagers in the streets and illegally parked cars,he noted that his customers do not loiter in the street and that he asks his customers to park in his rear parking lot. Regarding skid marks in the street from reckless driving,Mr.Johler stated that the only marks in the street are from a neighboring company's use of a skid steer. As for loud stereos,Mr. Johler stated that he does not install stereos. Shortage of on street parking for clients,Mr.Johler tells his customers to park in his rear lot. Acting Chairman Geinosky questioned the petitioner as to what work he has done and what type of work he intends to do. M.Johler noted that currently he is selling and fabricating performance automotive parts. If approved,he stated that they would expand his operations to include the installation of those parts and also build custom engines. Acting Chairman Geinosky asked if he would be performing any bodywork or painting. M. Johler stated that he would not. Commissioner Sokolowski asked how he would be testing the custom built engines. M.Johler stated that he has a Dyno tester,but that he cannot install it without approval. Commissioner Sokolowski questioned the amount of noise created by the Dyno tester. M.Johler stated that it is extremely loud,and as a result -2 - he would also need to soundproof the room that the tester is in. Without the soundproofing,he noted that it would be too loud to work. M. Johler stated that he wants to be located in Elk Grove Village and that it is his goal to be a good neighbor. Commissioner Sokolowski stated that it is the Plan Commission's job to control the development and ensure that the surrounding neighbors are looked after. Commissioner Ayers noted that the petitioner purchased the building in 2005,and also noted that the petitioner would have had to know the zoning of the building when he purchased his business license. S. Trudan stated that the petitioner listed on his zoning application metal manufacturing and warehousing. M.Johler stated that before he moved to Elk Grove Village his previous location was too small to do anything more then what he was doing. He stated that it was not until after he moved to Elk Grove Village that he realized he had more opportunities due to the size of the facility. Commissioner Ayers stated that the petitioner indicated that he would park all of his cars inside his facility. M.Johler stated that due to the circumstances with housing court,he is not allowed to have any vehicles stored within the building. Commissioner Ayers noted that there are eleven cars in the rear of the facility and that the petitioner submitted a parking plan showing only seven(7)parking stalls. Commissioner Ayers noted that character counts in Elk Grove,and that he did not believe the petitioner should automatically receive a favorable vote. Commissioner Ayers noted that the Village previously referenced the character of a housing developer seeking approval to build condominiums,and noted that he did not feel this issue was any different. Commissioner Paliganoff stated that he was not sure the revised parking plan was accurate,and he asked the petitioner if he drew the plan himself. M. Johler stated that he drew the parking plan. Commissioner Paliganoff asked the petitioner if staff advised him to get the parking plan professionally done. M.Johler stated that M.Roan was OK with the parking plan submitted. Commissioner Paliganoff asked M.Roan if that was a correct statement. M. Roan stated that he felt the plan was sufficient as submitted since it showed that the petitioner was able to accommodate the required seven(7),9'x19'parking stalls within the seventy foot(70')wide parking lot. M.Roan noted that the petitioner only needs 63' of the 70' to meet the minimum requirement for parking. Commissioner Paliganoff asked the petitioner if he would be willing to have a professionally designed parking plan. M.Johler stated that he would. Commissioner Hauser asked the petitioner what type of business he did when he was in Arlington Heights. M.Johler stated that he performed retail and wholesale of performance automotive parts. Commissioner Hauser asked the petitioner what was sold. M.Johler listed off several performance automotive parts that he sells from his shop. M.Johler noted that the retail side of his operation consists of approximately 600-700 square feet. Commissioner Hauser noted that when he went to visit the site he saw ten(10)cars parked in the rear of the facility, seven(7)parked on the street on Bennett,of which two(2)had their hoods opened with a guy under one of them. Commissioner Hauser asked if One 6 Motorsports was the name of a club. M.Johler stated that it was not. Commissioner Hauser asked if operations could be confined within the lot. M.Johler stated that they could. - 3 - Commissioner Hauser noted that there were a lot of parts stacked inside the shop. M.Johler stated that there was still plenty of room to perform the work he was seeking permission to perform. Commissioner Hauser noted that in response to the zoning requirements outlined by the Department of Engineering&Community Development,the petitioner never stated that he would be willing to install the required fencing. M.Johler stated that once the petition was approved,he would be willing to install the fencing. Commissioner Meyers stated that he was interested in the petitioner's comment about putting up the signage. He noted that no signage was posted when he visited the shop today. M.Johler stated that the signage is not currently posted. He noted that he ordered the signage today,just after receiving the anonymous neighbor letter from his attorney. Commissioner Meyers stated that he is voting to not approve the Special Use due to the petitioner's past history with the Village and the comments made by the neighbor. Commissioner Henrici noted that the petitioner continues to mention fabrication of products,but that he never indicated what products were being fabricated. M.Johler stated that he fabricates air induction systems and custom exhausts. Acting Chairman Geinosky questioned the hours of operation. Mr.Johler stated that his hours of operation would be Monday through Saturday,from 10:00 a.m.until 7:00 p.m. Acting Chairman Gemosky noted that he was not sure what was meant by fabrication. M.Johler stated that other businesses in Elk Grove produce certain component parts and he assembles and welds them together. J. Clery noted that his client made a mistake,but he is present to rectify the situation. He also noted that they were aware of several other nearby shops doing the same operation without a Special Use permit. J. Clery stated that it was true his client was taken to court to cease operations,but he wants to be in Elk Grove and wants to do what is right. In regard to Commissioner Meyers's comments about the signage, he noted that his client was not aware there was an issue until he received a copy of the letter today. Commissioner Thompson noted that he did not care about the court order. He noted that the petitioner has not done what a business is supposed to do. Commissioner Thompson stated that businesses must be able to work with one another. J.Clery stated that his client was under the impression that there was nothing wrong with the neighbor since no one ever complained. J.Clery noted that once he was advised of the problems he stopped and now wants to do what is right. Commissioner Meyers stated that he could understand why a neighbor would file a letter as anonymous since he could be forced to co-exist next to him if approved. J.Clery stated that his client is young and has learned a valuable lesson the hard way. Commissioner Sokolowski asked if the petitioner would still remain in Elk Grove even if he lost his request for the Special Use. Mr.Johler stated that he would like to stay. He also noted that he would still be able to conduct approximately 75%of the operations he has intended to do even without the Special Use permit. S.Trudan stated that he would like to add another comment. He noted that the petitioner previously advised staff that he has done some interior work without obtaining a permit. He also noted that permits would be needed for additional work needed inside the building. M.Johler stated that the only work that -4- was done without a permit was the installation of a lift,which he did not know he needed at the time. He also stated that he had filed for the permit four(4)days ago. With no further questions,Acting Chairman Gemosky asked for a motion. RECOMMENDATION Commissioner Ayers moved to recommend denial of the special use petition for Mr.Mark 7ohler at 610 Bennett Road. Commissioner Thompson seconded the motion. Upon voting(Geinosky,Hauser, Sokolowski,Thompson,Meyers,Paliganoff,Ayers AYES,Henrici,NAY,Glass,Absent)the motion carried. Item 3: Adjournment Commissioner Meyers moved to adjourn. Commissioner Thompson seconded the motion. Upon voting (Geinosky,Hauser,Henrici, Sokolowski,Thompson,Meyers,Paliganoff,Ayers AYES,Glass,Absent) the motion carried.
