Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled
meeting of the Village President and Board of Trustees on January 11.2005 ,this Executive Session
was called to consider a Litigation matter.

Litigation
The Mayor and Board were updated on the Village's Class Action lawsuit that was brought on
by Prime Co(now known as U.S. Cellular). This lawsuit stems from their dispute over the
Village's requirement for cellular companies to pay the Infrastructure Maintenance Fee(IMF).
The courts have recently ruled in favor of U.S. Cellular.
The Village must now decide whether to pay off the$12,800 awarded to U.S. Cellular or
continue to fight the lawsuit at a cost of$0.25 per resident. It was noted that some
municipalities have settled.
A question was raised regarding the ramifications of this decision and whether or not other
cellular carriers would also be able to sue the Village. It was noted that it would not likely
affect what other carriers do since U.S. Cellular has been filing their IMF returns under protest
from the beginning. The Board directed staff to pay the$0.25 to challenge the lawsuit.
