Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on April 12,2005
this Executive Session was called to consider a Litiaation matter.

The participating municipalities lost in court regarding the class action
lawsuit on the Infrastructure Maintenance Fee being applied to all wirelss
providers, rather than Primeco only. The exposure to the Village is
approximately $400,000.
The Village charged cellular carriers the IMF because State law allowed
municipalities to do so. In addition, Federal law also allowed this fee in�l
order to level the playing field with landline telecommunications
companies.
