Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled
meeting of the Village President and Board of Trustees on June 21. 2005 ,this Executive Session was
called to consider a Liti agation matter.

It was noted that Village staff has met with representatives from the Park District and have
reached a tentative agreement on a payback plan. In addition,the proposed resolution would
keep the Village out of any potential lawsuits.
The Park District's payback plan would be as follows:
Now to December 31,repay any runoff claims.
January 1,2006 -$130,000
January 1,2007-$130,000
January 1,2008—Balance Due
In addition,the Village keeps any reinsurance paid due on Park District claims. The consensus
of the Board was to have the Park District prepare and approve the necessary agreement and
make it available for approval by the Village Board.
