LISSNER Village Trustee COPY O P Y J.PETRI Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on September 13. 2005 ,this Executive Session was called to consider a Litigation matter. Number of pages attached: 1 Date(s)of review for release: July 2006 Date of approval for release: 9/13/05 6:25 p.m Lineation The Village Attorney noted that Marcia Rittenhouse has threatened litigation and an injunction to stop building on the Centex house if certain financial considerations were not made to her. If it is litigated, it would take approximately six (6)to nine(9)months to litigate and Centex needs clear title before they begin any work on the home. It was noted that a re-vote needed to be taken on the vacation of right-of-way since only five (5) of six(6)needed votes were present. The Village Attorney stated that he believed Ms. Rittenhouse would accept$12,500,but she is asking for more money. A question was raised that if the Village paid Ms. Rittenhouse $20,000,would we be obligated to pay the neighboring property owner the difference. A question was also raised about what the Village's response should be if she were to go to the press first. It was the consensus of the Board to allow the Village Attorney negotiate a settlement not to exceed$27,500. The meeting adjourned at 6:45 p.m.
