Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on September 27. 2005 this
Executive Session was called to consider a Litigation matter.

Litigation
It was reported that the Village has reached a settlement with FGM in
regards to the Public Works renovation litigation. The payout would re-
coup the legal fees the Village expensed and out-of-pocket delay costs. The
settlement also releases the Village from liability from 3 other contractors.
The consensus was to approve the agreement under New Business during
the upcoming Village Board meeting.
The meeting adjourned at 5:26 p.m.
