Mr. Kaplan called the meeting to order at 7:00 pm and read the legal notice. The
petitioner, Mr. Joseph B. Belmonte was sworn in and asked to present his case.
Mr. Belmonte explained he wants to replace the existing fence that is located twenty-nine
feet, six inches(29'6")beyond a line extended from the nearest front corner of the
principal building located on the adjacent single-family lot. Mr. Belmonte stated the
existing fence was constructed in the mid 1990s. The petitioner said he needs a fence in
order to keep his dog in his yard, give his three children a safe place to play in the back
yard, and keep unwanted individuals from entering his pool. Mr. Belmonte said he was in
the process of repairing the fence when on August 23, 2007 a strong storm had knocked
down and severely damaged the existing fence. Mr. Belmonte stated that he has tried to
repair the existing fence and nothing that he has done has kept it together. He reiterated
that not having the ricw fence up was a major safety concerti because of the pool in his
back yard. Mr. Belmonte mentioned that he did petition all of his surrounding;neighbors
and found that there were no objections to replacing his old fence.
Mr. Kaplan opened the meeting to questions from the board.
Mr. Michalski asked Mr. Belmonte the age of his children. Mr. Belmonte replied by
stating his four children are ten, thirteen, fifteen, and seventeen. Mr. Michalski had no
further questions, and stated that the existing fence was definitely in need of repair.
Mr. Walz had no questions for the petitioner.
Mr. Childress mentioned that the petition Mr. Belmonte sent around to his neighbors was
creditable and checked out to be acceptable. Mr. Childress asked the petitioner if the
neighbor directly behind Mr. Belmonte's residence, and whom the fence also mostly
affects had any objections to the replacement of the fence. Mr. Belmonte replied that his
neighbor has no objections and would like to see Mr. Belmonte's fence replaced as soon
as possible.
Mr. Schumm stated that he reviewed the Mr. Belmonte's petition and has no further
questions.
Mr. Dohrer stated that he went out to the residence and observed that all of the sight lines
from his neighbor's driveway were not obstructed by fence location. Mr. Dohrer had no
further questions or concerns.
Mr. Kaplan received all of the letters from the surrounding neighbors of Mr. Belmonte.
From the letters Mr. Kaplan found no objections to the replacement of the fence. Mr.
Kaplan concluded the fence was in need of replacement for quite some time even before
the storm damaged it. Mr. Kaplan sought out any more questions for the petitioner, and
then entertained a motion. A motion was made by Mr. Schumm,which was seconded by
Mr. Walz. Upon voting(AYES—Michalski, Childress,Dohrer, Kaplan, Schumm,
and Walz) the motion passed to allow the fence to be constructed twenty-nine feet,
six inches (29'6") from a line extended from the nearest front corner of the principal
building located on an adjacent single-family residential lot.'Mr. Kaplan advised the
petitioner to contact the Village Clerk to find out when the Village Board would consider
the case. The meeting adjourned 7:15 P.M.
