Zoning Variation—Docket#07-9—1886 Gibson Drive
Mr. Kaplan called the meeting to order at 7:00 pm and read the legal notice. The
petitioner, Mr. Louis Sacco was sworn in and asked to present his case.
Mr. Sacco stated the reason for his variance request is to replace the existing fence that
extends fifteen feet (15) beyond a line extended from the nearest front corner of the
principal building located on the adjacent single-family lot. He said the fence was
damaged from a storm on August 29, 2007. He described his fence as in poor condition
with sections and pieces missing.
Mr. Kaplan opened the meeting to questions from the board.
Mr. Meister asked the petitioner if any of his neighbors had any problems with the
location of the existing fence.
The petitioner replied that two (2) of his neighbors had concerns when they saw the
public hearing sign in his yard. He added that, once they found out why the sign was
there, they had no problems with putting a new fence up where the existing one is.
Mr. Rodgers asked the petitioner when the existing fence was built. The petitioner
replied that the fence was there when he bought the house nine(9)years ago and did not
really know the exact date. Mr. Rodgers then asked if the neighbor behind the
petitioner's residence has any blind spots when driving in and out of their driveway. Mr.
Sacco replied that there is at least sixteen feet(16')between the fence and the road,
which allows for his neighbor to look both directions with no sight problems before
entering onto the street.
Mr. Oliveto questioned Mr. Sacco about how much the existing fence varied from the
ordinance. Mr. Sacco answered by stating the fence extends out approximately fifteen
feet(15') from the nearest front corner of his neighbors house.
Mr. Walz asked the petitioner how long the pool has been in his yard. The petitioner
replied that the pool was built two (2)years ago and permitted through the village.
Mr. Childress commented that he was personally out at the residence and found that there
were no blocked sight lines for the neighbor behind Mr. Sacco nor were there any utilities
being affected by the location of the existing fence.
Mr. Schumm asked the petitioner what type of fencing will the proposed fence be. Mr.
Sacco replied that the proposed fence would be of scallop styling. He went further into
detail on the scallop style as having four inch(4") spacing between six inch(6")wide
cedar boards with the tops of the fence having a moon like shape ranging from the four
feet (4') to five feet (5) above grade.
Mr. Kaplan then asked if there was anyone from the public who would like to speak. Jeff
Snyder, a neighboring resident at 1901 Albany Court, stated that he was in favor of Mr.
Sacco's request for variance. Mr. Snyder further explained that if Mr. Sacco moved his
new fence in towards the middle of his rear yard, he would loose a considerable amount
of fenced in yard due to the fact of the smaller lots located in the neighborhood.
Mr. Kaplan entertained a motion. A motion to grant the variation was made by Mr.
Schumm, and seconded by Mr. Childress. Upon voting (AYES—Rodgers, Oliveto,
Childress, Dohrer, Kaplan, Schumm,Walz, and Meister) the motion to grant passed
unanimously. Mr. Kaplan advised the petitioner, Mr. Sacco,to be present at the next
Village Board meeting for the final decision of his zoning variation. The meeting
adjourned 7:20 P.M.
