Johnson, Liquor Commissioner Trustee Samuel L. Lissner Trustee James P. Petri Also Present George B. Knickerbocker, Village Attorney Ann I. Walsh, Village Clerk Officer Kristen Julian, Elk Grove Police Department Smoke Hub Jayesh Patel Kanaiya Patel Mayor Johnson called the public hearing to order at 1:10 p.m. Jayesh Patel, Kanaiya Patel and Police Officer Julian were duly sworn in as witnesses herein. Officer Julian described the events leading up to the arrest of minors who had purchased alcohol at the Smoke Hub, 652 Meacham Road, on Friday, December 7, 2007. Officer Julian testified the Police had been watching the Smoke Hub due to a "tip" received that alcohol was easily purchased by minors and proper identification not required. Officer Julian testified that Smoke Hub had various paraphernalia and adult literature displayed at the counter in plan view. J. Patel stated the paraphernalia had been since removed and adult magazines have been covered. K. Patel responded to inquiries regarding ownership of the Smoke Hub. It was noted Mamta Patel, spouse of J. Patel, was the owner of record. K. Patel is employed as the manager. Mayor Johnson mentioned prior conversations he had with the Patels whereby he had warned them that the prior owners had problems and that he would not tolerate further problems at that location. 1 During examination by Village Attorney Knickerbocker, J. Patel confirmed the clerk on duty on December 7, 2008 no longer works at the Smoke Hub. A complete testimony of all proceedings is contained within the court reporter's transcript which is on file in the Village Clerk's Office. Upon hearing testimony, the Liquor Commission adjourned to deliberate in closed session (1:30 p.m.) The Liquor Commission returned to open session at 1:44 p.m. Mayor Johnson addressed J. and K. Patel and spoke of the issues brought forth during the public hearing. The following findings and orders were announced: 1. Respondent shall pay a fine in the amount of five hundred dollars ($500.00) by January 4, 2008. 2. Court Reporter fees shall be paid within ten (10) days of receipt of statement. 3. The Class B Liquor License issued to Smoke Hub shall be suspended for four (4) days commencing at 12:00 Noon on December 28, 2007 through 12:00 Noon on January 1, 2008. 4. Prior to the re-opening of the Smoke Hub, all paraphernalia items shall be removed from the store and all adult magazines shall be relocated and except for the title, shall be covered and not viewable by the general public. The proceeding in the above-entitled cause were adjourned at 1:50 p.m. Submitted by: Ann I.
