Mr. Kaplan called the meeting to order at 7:00 pm and read the legal notice. The
petitioner, Mr. Christopher J. Delutio was sworn in and asked to present his case.
Mr. Delutio explained he wants to replace the fence that is located thirty-three feet, six
inches (33' 6")beyond a line extended from the nearest front corner of the principal
building located on the adjacent single-family lot. Mr. Delutio stated that the existing
fence that he wants to replace is twelve(12) years old and deteriorating. The petitioner
further explained he installed a deck and swimming pool in his rear yard. Mr. Delutio
said that if he needed to comply with the ordinance it would place the new fence five (5)
feet from his deck. The petitioner explained his rear yard was already small in size, and
if he were to place the fence in the allowable location, then his rear yard would be
useless. Mr. Delutio finished by stating that he has lived there for sixteen(16) years.
Mr. Kaplan opened the meeting to questions from the board.
Mr. Schuinin asked the petitioner if any of his neighbors had any problems with the
proposed location of the fence.
The petitioner replied that two of his neighbors on Alabama Drive said they had no
problems with the location of the existing fence and would have no problems with
replacing it with a newer fence.
Mr. Schumer asked the petitioner what type fence he was proposing to replace the
existing with.
The petitioner replied the new fence would be a white PVC fence the same height as the
existing.
Mr. Oliveto stated there are some sight line issues when backing out of the neighbor's
driveway. Mr. Oliveto explained that he would like to see the fence brought in a few feet
to help with the sight lines from the neighbor's driveway and decrease the chances of a
vehicular accident.
Mr. Kaplan explained that he personally spoke to the neighbor located behind Mr.
Delutio, and the neighbor had no problems with the existing fence's location or replacing
it with a PVC style fence.
Mr. Meister reiterated that the new fence would be located in the same location as the
existing fence.
Mr. Rodgers added that his question was already answered about the type of fence the
petitioner is going to install.
Mr. Childress had no questions or objections.
Mr. Walz complemented the petitioner on the overall look of his residence. Mr. Walz
then added if the petitioner were to bury his sump pump discharge pipe that it would
compliment the nice looking residence.
Mr. Dohrer had no questions or comments.
Mr. Kaplan entertained a motion. A motion to grant the replacement of an existing fence
located thirty-three feet six inches (33' 6")beyond a line extended from the nearest
front comer of the principal building located on the adjacent single-family lot was made
by Mr. Oliveto, and seconded by Mr. Childress. Upon voting(AYES —Oliveto,
Rodgers, Childress, Dohrer, Kaplan, Schumm, Walz, and Meister) the motion to
grant passed unanimously. Mr. Kaplan advised the petitioner, Mr. Delutio, to be
present at the next Village Board meeting for the final decision of his zoning variation.
The meeting adjourned 7:13 P.M.
