Zoning Variation —Docket# 08-1 — 812 Schooner Lane
Mr. Kaplan called the meeting to order at 7:00 pm and read the legal notice. The
petitioner, Mr. Zubair Igbal was sworn in and asked to present his case.
Mr. Igbal explained he wants to install a fence that is located fifteen feet (15') beyond a
line extended from the nearest front corner of the principal building located on the
adjacent single-family lot. Mr. Igbal stated that his family just moved in a few days ago
and this was their first single-family home. The petitioner said that his two kids have
allergies to dogs and cats. Furthermore, the reason for the fence was that he wanted to
keep stray dogs and cats out of his yard. Mr. Igbal added that the permissible location of
the fence allows for the fence to start in the middle of his rear dining room window and
he did not want to have the fence at this location.
Mr. Kaplan opened the meeting to questions from the board.
Mr. Michalski asked the petitioner if any of his neighbors had any problems with the
proposed location of the fence.
The petitioner replied the neighbor located behind him that would be affected the most by
the fence's location did not see any problems. He added that, once they found out the
fence was being constructed to keep dogs and cats out of the yard and not the opposite,
they had no problems with putting a new fence up fifteen feet(15') in front of their
house.
Mr. Walz clarified that the variance was for fifteen feet (15') instead of ten feet (10').
The petitioner replied that fifteen feet (15') was the requested length for the variance.
Mr. Dohrer stated that the petitioner has a large rear yard and would like to see the west
section of the fence started at the northwest corner of the house therefore only requiring a
variance of three (3') to four feet(4').
Mr. Dohrer questioned about the southeastern section of fence because it too could be
outside of the allotted locations within zoning ordinance.
The petitioner replied that the southeastern section of fence will be,held back behind the
front corner of the neighbor's house and will be in compliance with the zoning ordinance.
Mr. Schumm stated that he was at the residence and noticed that there are three (3) trees
located in the vicinity of where the fence was to be constructed. Mr. Schumm asked Mr.
Iqbal if the proposed location of the fence would place the trees outside or inside of the
fence. Mr. Schumm asked the petitioner what type the fence would be.
Mr. Igbal replied that he did not know exactly if the trees were going to be on the inside
or outside of the fence. The petitioner further added that he was not too concerned about
the type of fence and would install whatever was permissible in the village.
Mr. Kaplan then asked if there was anyone from the public who would like to speak. Mr.
and Mrs. Thomas Flanagan,neighboring residents at 808 Schooner Lane, stated that they
wanted to make sure that the proposed fence was not going to be located in front of their
house. Mr. Flanagan stated that they are the neighboring residents on the east side of Mr.
Igbal, and they have no problems with the location of the fence since it will not be out in
front of their house.
Mr. Kaplan asked the petitioner if he would consider moving the fence back a couple of
feet to help with the sight lines when backing out of the neighbor's driveway.
The petitioner said he would move the fence back, but did not want it to be directly off of
the northwest corner of his house.
Mr. Kaplan agreed with the petitioner. Mr. Kaplan stated that more clarification was
needed on the position of the trees so that a definite dimension on where the fence will be
placed could be decided on. Then, Mr. Kaplan asked the Department of Engineering and
Community Development to assist in helping the petitioner locate the trees on a plat of
survey. An agreement was made that the Department of Engineering and Community
Development would assist the petitioner in locating the trees. Finally, Mr. Kaplan
continued the meeting to Thursday, January 17, 2008.
