HomeMy WebLinkAboutVILLAGE BOARD - 04/17/1961 - VILLAGE BOARD 0 MINUTES OF AN ADJOURNED k1EETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ELK GROVE VILLAGE, ILLINOIS, HELD ON APRIL 17., 1961 President Charles A. Hodlmair called the meeting to cyder at 8:00 P.M. in the Ira L. Rupley School in said Village and asked the Village Clerk to call the roll. Upon the roll being called the following Trustees answered "PRESENT:" James L. Carroll, Francis J. Dillon, Leonard A. Scharringhausen, James R. Young; "ABSENT:" Robert E. Hartshorn, Char- les P. Smith. President Hodlmair reported having received 4 notices ofpublic hearing from the County Board of Zoning Appeals, to be held on April 26, 19 1, in the Mt. Prospect Village Hall 3:00 P.M.) President Hodlmair called particular attention to Docket #f178, regarding 2 acres located on the SE corner of Rohlwing Road a nd Biesterfield Road; the other hearings are identified as Dkts. ##171, 179, 191. Copies of these notices will be forwarded on to the Village Zoning Board of Appeals. (Trustee Smith arrived - 8:05 P.M.) Reporting on the items listed under his portion of t1e agenda, Attorney Hofert stated: 1 no report re parking along Elk Grove Blvd; 2 he is scheduled to appear before the County Board on Tuesday, April 18, 1961 (10:30 a.m.) regarding t1E Pionoer Trust Suit; (3) he contacted the architect regarding the need for fill at the municipal site and was informed there are several items which had not been considered in the contract - the builder is ll proceed rather than stop the job for deter- minathn of responsibility in these cases, believing it to be the Boardfs intention to make every effort to settle the question properly; (4) the subject of special use of land at Golf and Busse Roads is still before the County Board; (5) has previously submitted a letter authorizing the legal contribution of the Village of 1/2 the cost of Blue Cross in- surance coverage for the Police Department, but can see no way to justify such contribution, legally, for the other Village employees; (6) does not yet have the drafted agreement between Centex and the Jaycees re community center site (due by April 26, 1961). Insurance Agent of Record, Bob Larberg, present at this meeting, agreed to investigate the natter of insurance coverage for other than police personnel and report to Attorney Hofert. iMr. Evan Stebbins, Real Estate Manager for Centex Construction Comparq, i Inc., reported that the Jaycees attorney last week presented a draft of the agreement, which was forwarded on to Centex's Dallas office. I The Village Clerk read a proposed ordinance entitled "AN ORDINANCE; MIEND- ING THE VILLAGE OF ELK GROVE VILLAGE ZONING ORDINANCE AS TO PROPERTY ! LOCATED EAST OF ARLINGTON HEIGHTS ROAD AND, NORTH OF HIGGINS ROAD." In reporting on the meeting of the Committee-Of-TheAIhole, President Hodlmair stated that the concensus of the Buard was to recommend con- struction of a fence of a height to be directed by the Village Engineer in order to provide visual protection from Higgins Road traffic and the area across Higgins Road. With regard to the proposed tree planting, President Hudlmair reported that the concensus was the trees should be placed in line with the present Honeysuckle hedgerow, transplanting some of the bushes. It was proposed that these trees be bought by the Village and planted and maintained by the Higgins Road residents. It was moved by Trustee Young and seconded by Trustee Smith that the Board authorize anexpenditure not to exceed ��450. fir the pur- chase of 45 - 12" Silver Maple trees to be planted along Higgins Road, through the combined effort of the Higgins Road residents under the direction of Village Trustee James R. Young and the Village Engineer, with the understanding that these trees shall be cared for and watered by the residents of Higgins Road se: -"ice drive from Forest Lane to Wild- wood Road. Whereupon the It President declared the motion carried. In clarifying responsibility for construction of the Higgins Read fence, Mr. Evan Stebbins stated that this is an agreement between Centex Construction Company and the homeowners, with the Village Engineer to make his recommendations to Centex regarding specifications for the fence. It was moved by Trustee Young and seconded by Trustee Dillon that the Board waive the first reading rule with respect to the rezon- ing ordinance previously read. The President asked that the roll be Balled an the motion and upon the roll being called the following Trustees voted "AYE:" Carroll, Dillonx Scharringhausen, Smith, Young; "NAY:" None. Whereupon the President declared the motion carried It was moved by Trustee Scharringhausen and seconded by Trustee Young that Ordinance No. 167, entitled "AN ORDINANCE AMENDING THE VILLAGE OF ELK GROVE VILLAGE 7,0NING ORDINANCE AS TO PROPERTY LO- CATED EAST OF ARLINGTON HEIGHTS ROAD AND NORTH OF HIGGINS ROAD," be adopted. Whereupon the President declared the motion carried. Trustee Carroll presented 14 invoices, totaling $4,497.26, for approval. I It was reported, for the record, that the election booths and ballot boxes are currently being stored in the Police Department quarters. Trustee Scharringhausen reported that the Nurses Club is seeking space in which to store their equipment, and President Hodlmair suggested i a compartment within the top floor of one of the buildings at 780 Tonne Road be arranged. Trustee Scharringhausen reported a meeting of the Fire & Police Commit- tee was held at which the tank wagon bids were studied. Trustee Schar- ringhausen stated that the Committee recommended the lowest bidder be by-passed, due to a variation from the basic specifications for this equipment. It was moved by Trustee Scharringhausen and seconded by j Trustee Dillon that the Board accept the bid of Great Lakes Fire Equip- ment Companyincluding specified optional equipment, for an amount not to exceed $10,647., for the purchase of one 1,000 gallon tanker. (Trustee. Young clarified his "no Vote" position based a_a the fact that he has not had ample time to thorovahly examine the spec4_i'ications for this equipment.) Trustee Scharringhausen added that if the new Board of trustees decides to add the rest of the alternates to the truck, the truck could then to considered a third piece of fire-fighting equipment. Chief Mergen. reported that the State Fire Bureau would make an inspection sometime in September, Chief Mergen outlined the need for a cmmplete inspection of the wiring in the fire barn; Trustee Carroll agreed to contact Public Service-Co. regarding same, and the electrical de-partment agr^ed to check it` o'ut also. Trustee Dillon reported that the code of ordina-_:^s still has not gone to the printers and that he has secured two prices from two different printers - (a) $1,180. for 300 books assembled in a loose-leaf fashion, with printed cover and back; (b) 51.0,00. for 300 books stitched and bound. April 13, 1961, regarding Fences on Corner Lots: "The attached sheets for your information regarding erec- tion of fences on corner lots, as this is the question that came up after the Building Dept., denied permission to Pair. Keepper who lives at 598 Bianco Drive, to erect a fence ahoad of bu-1ding line on his corner Lot #1635, Section #4 Centex Section #33-41-11: No. 1 - Elk Grove Village Zoning Ordinance No." 20; In part co:-ering fences. No. 2 - New Municipal Code Bcok passed 3/27/61 - Section #24.028 covering fences on corner lots. No. 3 - Great Northern Development Company Covenants covering land usage - see Section #13 regarding Fences." It was further clarified that Mr. Keepper's proposed fence, while it I does violate the covenants with Great Northern Development Cnmpany, does not violate the ordinances of the Village noir in effect -- al- though it is in violation of the neer code of ordinances not yet published, (Trustee Hartshorn arrived - 9:20 P<M.) Attorney Hofert outlined the two possible cou_rsos of action by the Board, as follows: (1) defer action on the application until such time as the new code becomes effective - Mr. Keepper could then request a variation; through a hearing before the Zoning Board of Appeals; (2) because the new code is not yet in effect, issue the permit to built the fence immediately - this would create the problem of making special circumstances in this instance. Attorney Hofert further emphasized the fact that the Village has no authority to enforce the covenants. (There f cllcwed a lengthy discussion (luring which 'Mr. Keepper clarified i his position; Mr. Egan Stebbins reminded the Beard of the fact that- some residents in Section 1 North had been forced to remove fences in viola- tion of the covenants, Co!Lnissloner Scharringhausen defined the posi- tion of the Building Department, and Attorney Hofert outlined the Board's position.) It was moved by Trustee Smith and seconded by Trustee Dillon that the Board instruct the Building Department to issue a permit to ' Mr. W. Keepper, 598 Bianco Drive, for a fence in conformance with present ordinances and building codes. The President asked that the roll be called on the motion and rnon the roll being called the following Trustees voted "AYE:" Dillon, Smith; Young; "NAY:" Carroll, Scharring- hausen; "ABSTAIN:" hartshorn. The vote being three "ayes" andt n, -3- (Adj.) 4/17/6! "nays" with one Trustee abstaining from the vote, the question was put to President Hodlmair. President Hodlmair voted "NAY:" whereupon the motion was not carried. It was moved by Trustee Smith and seconded by Trustee Young that application for fence variation for Mr. W. Keepper, 598 Bianco Drive, be referred to the Zoning Board of Appeals and that the hearing fee for such variation be waived. The motion was voted upon by acclama- tion; whereupon the President declared the motion carried. Trustee Carroll inquired of Trustee Young the status of the street sweeper bids, whereupon Trustee Young stated he is still investigating this equipment and is not yet ready to recommend the purchase of any one make: The Village Clerk read a letter from Engineer Fletcher recommending that the Board Lpprove the engineering plans of Unit #2, Higgins Road Commercial, subject to payment of the required fees. It was moved by Trustee Young and seconded by Trustee 6�nith that the Board adopt the Engineering Plans for Unit 2 , Higgins Road Commercial, in concurrence with the recommendation of the Village Engineer. The President asked that the roll be called on the motion and upon the roll being called the following Trustees voted "AYE:" Carroll; Dillon, Hartshorn, Scharringhausen, Smith, Young; "NAY:" Nene. Whereupon the President declared tY,e motion carried. The Village Clerk presented a proposed resolution requesting fro.a the Dept. of Public Works and Buildings, State of Illinois, a permit authorizing construction of a street intersection (King St.) with Higgins Road, such resolution having been approved by the engineer's representat;_ve. It was moved by Trustee Young and seconded by Trustee Carroll that Resolution No. 11-613 REQUESTING A PERMIT FROM THE DEPARTMENT OF PUBLIC WORKS AND BUILDINGS, STATE OF ILLINOIS, TO CONSTRUCT A STREET INTERSECTION (KING STREET) WITH HIGGINS ROAD (STATE ROUTE 72) COMPIE TE WITH CULVERT, be adopted. The President asked that the roll be called on the motion and upon the roll being call-3d the following Trustees voted "AYE:" Carroll, Dillon, Hartshorn, Scharringha•isen, Smith, Young; "NAY:" None. Whereupon the President declared the motion carried. The Village Clerk reported receipt of notice of Municipal Sales Tax Refund for January, 1961, in the amount of X2065.65; also, notice of Motor Fuel Tax allotment for March, 1961, in the amount cf X2,466.02. It was moved by Trustee Scharringhausen and seconded by Trustee Carroll that the meeting be adjourned.
