PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF ELK GROVE VILLAGE,
HELD ON FEBRUARY 23, 1961
At the request of Trustees Frank Dillon and Charles Smith, thefollowing
notice was sent to the President, Attorney, and all Trustees of the Vil-
lage of Elk Grove Village, on February 22, 1961: "Pursuant to a request
from Messrs. Dillon and Smith, you are hereby notified of a Special
Meeting to be held at the Ira L. Rupley School on Thursday, February 23,
1961, at 9:3n P.M. for the purpose of discussing the Pioneer Trust vs.
County of Cook court case."
President Charles A. Hodlmair called the meeting to order at 9:15 P.M.
at the Ira L. Rupley School and asked that the roll be called. Upon the
roll being called the following Trustees answered "Present:0 James L.
Carrell, Francis J. Dillon, Robert E. Hartshorn, Leonard A. Scharring-
hausen, James R. Young; "ABSENT:" Charles P. Smith. Also present at
this meeting - Mr. Everett Lewy, School Board Attorney and Mr. Edward C.
Hofert, Village Attorney.
Mr. Hofert reported having distributed letters reviewing the background
of the case to all Trustees and the President, in order to fully acquaint
them with the facts. Mr. Hofert also supplied the Board with copies of
a proposal letter submitted by Oasis Outdoor Inc., providing for a cash
reimbursement to the School District #f59 - annually - to compensate for
the burden which the proposed trailer court would create.
Mr. Lewy reported that the President and members of the School Board had
unanimously agreed to accept the proposal. Mr. Lewy then related the
history of the Herzog case, in which the School District has been involved
in extensive litigation to enforce an agreement between the developer and
the School District.
It was moved by Trustee Dillon and seconded by Trustee Young that
the Village Board turn down the proposal submitted by Cesis Outdoor Inc.
in settlement of the Pioneer Trust case. The President asked that the roll
be called on the motion and upon the roll being called the following Trus-
tees voted "AYE:" Carroll, Dillon, Hartshorn, Scharringhausen, Young;
"NAY:" None. Whereupon the President declared the motion carried.
It was moved by Trustee Dillon and seconded by Trustee Carroll
that the meeting be adjourned. The motion was voted upon by acclamation;
whereupon the President declared the motion carried and the meeting was
aajourned at 10:20 P.M.
