Chairman Glass called the meeting to order at 7:10 p.m.
Item 1: April 16, 2008 Meeting Minutes
Commissioner Geinosky motioned to approve the April 16, meeting minutes. Commissioner
Henrici seconded the motion. Upon voting (Ayers, Geinosky, Hauser, Thompson, AYES,
Glass, Henrici, Meyers, Paliganff, ABSTAINED, Sokolowski, ABSENT) the motion carried.
Item 2: 820 Nicholas Boulevard— Special Use
Chairman Glass read the legal notice for the record.
Petitioner, Matthew Keefe, briefed the Commission on the history of his businesses in Elk
Grove. Mr. Keefe's primary business of fourteen years has been K&K Contractors, a demolition
and excavation company. In November of 2006, Mr. Keefe started K&K Diesel Repair. In
September of 2007, he entered into a lease at 820 Nicholas, with the option to purchase, which
still stands. This property is utilized as Mr. Keefe's office, a storage facility, and a warehouse to
repair his own vehicles.
Mr. Keefe employs three (3) mechanics and two (2) office personnel. His mechanics currently
repair his own equipment. Area contractors have approached Mr. Keefe's mechanic, Brad
Carpenter, about repairing their vehicles.
Mr. Keefe leases the property at 820 Nicholas and the adjacent property at 720 Richard Street.

Commissioner Thompson asked Mr. Keefe what he would do if the building at 820 Nicholas
sold. Mr. Keefe expressed his intention to purchase 820 Nicholas in the future. Currently he is in
the fourth year of a fifteen (15) year lease.
Commissioner Ayers requested clarification on the vehicle he saw parked outside 820 Nicholas
Street on the morning of September 3. He also wanted to know when Mr. Carpenter began
working on Mr. Keefe's vehicles, what initiated the Special Use application.
Mr. Keefe explained that the truck he saw was Mr. Keefe's personal vehicle. Mr. Carpenter has
been working for Mr. Keefe since November of 2007 and an Engineering inspection initiated the
Special Use application.
Commissioner Ayers was concerned that vehicles may be stored at 820 Nicholas rather than on
Richard Street. Mr. Keefe stated that.80% of this work is completed within 24 hours and he will
not store vehicles outside his building. Commissioner Ayers doesn't view 820 Nicholas as the
most appropriate site for this use. He believes the Commission's stipulations might be ignored
and parking would become an enforcement issue because, often mechanics are required to order
parts that are not in stock.
Commissioner Paliganoff asked Mr. Keefe if he was required to widen his driveway entrance
and asked for clarification on the loading dock issue. Mr. Keefe stated that his entrance is the
widest on Nicholas and his thirty-foot trucks were able to navigate through the turn. He also
explained the work done on the loading dock was done prior to K&K's lease.
Commissioner Hauser requested clarification on the lease at 720 Richard Lane, where vehicles
are currently being repaired, and what K&K will do in the winter months. Mr. Keefe stated he
has a formal lease with JMC LLC. De Meo Brothers Construction owns the property at 720
Richard Lane. He noted that much of his repairs are being done at 720 Richard Lane and he
assured the Board he would move vehicles to Richard Lane overnight in the winter even if he
had to do it himself.
Commissioner Meyers questioned staff about the outstanding items noted in the Director of
Engineering & Community Development's memo dated July 23. Mr. Keefe informed the
Commission that he has obtained a permit for the sidewalk and will apply for the driveway
permit, although the work was done before he entered into the lease at 820 Nicholas.
Commissioner Meyers then asked the petitioner if he intends to upkeep the property and what
work is currently underway inside the property. Mr. Keefe confirmed he would maintain the
landscaping and that he currently is installing three catch basins. He also confirmed thay he has a
building permit for that work.
Commissioner Henrici requested clarification on how many bays K&K plans to have. Mr. Keefe
noted that he has six bays, which currently meets code and must be maintained as part of the
Special Use.
Commissioner Geinosky requested K&K's hours of operation and where they would keep
inoperable vehicles. Mr. Keefe stated his hours of operation are 7:00 a.m. to 4:00 p.m. and his
business is not open on the weekend. Inoperable vehicles would be stored inside.

Chairman Glass asked if Mr. Keefe intended to hire more mechanics at any time. Mr. Keefe
stated that his business had found its niche and he does not want to hire additional mechanics or
enter into retail.
Commissioner Hauser requested the petitioner to provide the Village with a copy of his lease at
820 Nicholas. Mr. Keefe agreed to deliver the lease to Village staff.
Commissioner Geinosky moved to recommend approval of a Special Use Permit for K&K Diesel
Repair Inc. to operate an automobile and truck repair garage in an I-1 Industrial Zoning District,
located at 820 Nicholas, and based upon the following conditions:
1. The petitioner will pull a permit for their driveway.
2. The petitioner will improve the driveway to meet Village requirements.
3. The petitioner will maintain the lease or purchase the property at 820 Nicholas.
4. The petitioner will not have any outside storage of vehicles.
Commissioner Meyers seconded the motion.
Commissioner Henrici stated that he would not support this Special.Use application if the
property is not large enough for this use and the Village is depending on adjacent unincorporated
property to assist this business with storage.
Commissioner Ayers stated that he would not support this Special Use application because
Village staff will have to continually inspect this property to ensure compliance with the Special
Use and even if they get ticketed, the Special Use is still active. He also states that he feels this
Special Use is setting a precedent for additional businesses with off site storage to approach the
commission.
Upon voting (Meyers, Geinosky, Glass, Paliganoff, Thompson, AYES, Hauser, Henrici, Ayers
NAY, Sokolowski, Absent) the motion carried.
Item 3: Adjournment
Commissioner Hauser motioned to adjourn the meeting and Commissioner Meyers seconded the
motion. Upon voting (Ayers, Meyers, Geinosky, Glass, Hauser, Henrici, Paliganoff, Thompson,
AYES, Sokolowski, Absent) the motion carried.
The meeting was adjourned at 8:12 p.m.
