Zoning Variation — Docket# 08-11 —217 Wellington Avenue (Meeting continued
from December 4, 2008)
Chairman Kaplan called the meeting to order at 7:00 pm and briefly went over what was
discussed at the prior meeting on December 4, 2008. Mr. Burns was absent and had his
wife, Mrs. Burns, represent him for the meeting. Chairman Kaplan swore in the petitioner
and asked Mrs. Burns if she had any comments or concerns about the new location. A
new plat of survey had been modified with the compromised fence location and was
previously reviewed by the board and petitioner.
Mrs. Burns stated there were-no concerns she or her husband had about the new proposed
fence location. She thanked the Village for the assistance the Department of
Engineering and Community Development had given them to come up with the new
fence location.
Chairman Kaplan opened the meeting to questions from the board.
Mr. Childress went into an explanation of the new proposed location. He stated the
southwest corner fence post was extended out in the same direction as the western section
of the existing fence and located at the twenty-five foot (25') building setback line along
Somerset Lane. He further described the southern section of the fence as being laid out
ninety degrees (900) from the western section of fence, and the eastern section of fence
being extended out along the same line as the existing eastern section of fence. Mr.
Childress asked the petitioner if the neighbor located behind their residence had any
problems with the proposed fence location.
Mrs. Burns replied the neighbor has no problems with the proposed fence location.
Mr. Schumm asked Mrs. Bums if the new fence would be the exact same style as the
existing fence.
The petitioner answered that the fence would match as close as possible to the existing
fence.
Chairman Kaplan entertained a motion. A motion to grant a variance for the
compromised fence location of approximately five feet(5') beyond a line extended from
the nearest front corner of the principal building located on the adjacent single-family lot
was made by Mr. Meister, and seconded by Mr. Childress. Upon voting (AYES —
Kaplan, Oliveto, Childress, Schumm, Carlson, and Aleister) the motion to grant the
variance passed unanimously. Mr. Kaplan advised the petitioner, Mrs. Burns, to be
present at the Village Board meeting on January 27, 2009 for the final decision of the
zoning variation. The meeting adjourned 7:10 P.M.
