HomeMy WebLinkAboutJPZ - 06/02/2009 - LICENSING OF BUSINESSES/LANDSCAPE MAINT ELK GROVE VILLAGE JPZ COMMITTEE MEETING June 2, 2009 7:00 PM JPZ Members Present: Sam Lissner, Village Trustee, Chairman Jeff Franke, Village Trustee Chris Prochno, Village Trustee Staff.- Ray Rummel, Village Manager Matt Roan, Deputy Village Manager Al Boffice, Director, E & CD Steve Trudan, Deputy Director, CD Christine Tromp, Director of Finance Steve Schmidt, Police Chief Plan Commission : John Glass, Chairman John Meyers Fred Geinosky Chuck Henrici Don Sokolowski Ted Thompson Audience: Paul Petzel LICENSING OF BUSINESSES Chairman Lissner explained that the purpose of the meeting was to discuss problems associated with businesses operating within the Village without first obtaining the required permits and or licenses, one specific problem being automotive uses illegally operating in industrial districts and subsequently applying for a special use permit after being caught by Village inspectors. Mr. Rummel explained that staff researched the problem and concluded that appropriate procedures are in place to enable the Village to identify illegal uses and prevent their operation. It is only situations when property owners and tenants fail to follow our procedures that illegal uses operate within the Village. He added that the larger building and property owners follow our procedures and generally do not create problems. Mr. Rummel suggested that the Village pursue an educational oriented approach in the form of a pamphlet or newsletter that explains our requirements and the penalties for failing to follow them. i i Mr. Meyers suggested that all businesses should be required to obtain a business license and display a sticker at the place of business. Mr. Boffice explained that the license and sticker would not solve the problem that I arises when a business legally occupies a building and, in time, changes or modifies the activities that occur within the building without informing the Village. I Mr. Glass acknowledged the merit of a newsletter and noted that there was no foolproof way to catch every illegal use. He added that making the property owner responsible was a key to effectively control the problems. Mr. Rummel suggested that the best approach at this point in time was the educational approach, citing concerns and costs associated with other approaches. Mr. Geinosky asked if there was a way to identify changes in property ownership. It was indicated that real estate transfer stamps identified ownership changes. Mr. Rummel suggested that the Fire Department could deliver newsletters to each building when they make their routine inspections. Mr. Glass suggested that building permit requirements be added to the newsletter. LANDSCAPE MAINTENANCE Mr. Meyers brought up discussion about how the Village could or should be monitoring the maintenance of landscaping plans that are reviewed and approved by the Plan Commission as part of a site plan approval. Mr. Rummel stated that the Village could keep the topic "on the radar"but added that now is not the time to enforce landscaping maintenance given the state of the economy. Mr. Trudan explained that the topic was studied in previous years and it was determined that the Village could not persue such a program due to the added levels of staff, expertise and supervision that would be required to do so. Mr. Sokolowsky inquired about how the Village addresses the maintenance of drainage ditches in the industrial areas. Mr. Rummel explained that it was handled on a complaint basis and that the topic is part of the master plan of the ICRC. He invited anyone interested to contact Mr. Boffice for further information. Chairman Lissner reminded the members of the Plan Commission that they are invited to attend the ICRC Master Plan Meeting in the Council Chamber, Monday, June 29 at 6:30 p.m. The meeting adjourned at 7:50 P.M.
