Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled
meeting of the Village President and Board of Trustees on October 28, 2008, this Executive
Session was called to consider a Litigation matter.

Litigation
A friend of Mrs. Miller's son borrowed his car and damaged a light pole. The person liable for
the damage owes the Village $3,000. The Village litigated against the friend and he agreed to
pay. The friend then moved back to Georgia and never paid. Now that the gentleman responsible
has not paid, the Village is pursuing the vehicle's owner. The case came up in May 2008. Mrs.
Miller is upset that the Village called her insurance company. She thinks that her insurance is
going to drop her. Her insurance will probably pay for the damages and then they will go after
her.
