Zoning Variation — Docket# 09-6— 1098 Leicester
Chainnan Kaplan called the meeting to order at 7:00 pm and read a statement describing
the hearing notification procedure as well as the legal notice. The petitioner, Jerry
Czyzewski was sworn in and asked to present his case.
Mr. Czyzewski said that after building a deck around the pool he had extra material and
wanted to add to the deck to make it as large as possible.
Mr. Childress asked for clarification regarding the construction of the deck.
Mr. Carlson asked the petitioner why he waited so long to respond to communication
requested by the Village. The petitioner stated that he responded within the time
requested by the Village.
Chairman Kaplan explained that the purpose of the hearing was to evaluate the
petitioner's request and make a recommendation to the Village Board based solely on the
testimony. He added that the pending court case constituted a separate issue between the
petitioner and the Village.
Mr. Childress asked for more clarification regarding the construction of the pool deck.
The petitioner stated that the pool and the deck replaced a pool and deck that existed
when he bought the house. He added that he moved the heater as requested by the
Village to meet code and that he would have built the deck all the way to the back fence
If he could.
Mr. Meister questioned the size of the deck and asked the petitioner if his variation
request was due to a hardship. The petitioner said there was no hardship.
Mr. Dohrer asked if the petitioner submitted drawings to the Village and asked why he
did not follow the approved plans. The petitioner responded by saying he just wanted
more.
Mr. Schunnll asked if the petitioner received any complaints from neighbors. The
petitioner said no.
Chairman Kaplan asked if anyone in the audience wished to comment. Mr. Joe Sagerer
of 516 Banbury said he lives behind the petitioner and has no problem with his plan.
Chairman Kaplan explained once again that the citations issued to the petitioner by the
Village had no bearing on the hearing and asked for a motion.
A motion was made by Mr. Walz, and seconded by Mr. Dohrer to NOT GRANT the
proposed variation. Upon voting the motion passed unanimously. Chairman Kaplan
advised the petitioner that the recommendation of the Zoning Board would be forwarded
to the Mayor and Board of Trustees who will make the final decision. He advised the
petitioner to contact the Village Clerk and attend the subsequent Village Board Meeting.
The meeting adjourned at 7:15 p.m.
