HomeMy WebLinkAboutORDINANCE - 3483 - 3/14/2017 - 1635 Biesterfield Conveyance EG Park Dist to Village ORDINANCE NO. 3483 ORDINANCE DECLARING THE NECESSITY AND CONVENIENCE OF THE CONVEYANCE OF CERTAIN PROPERTY LOCATED AT 1635 BIESTERFIELD ROAD IN ELK GROVE VILLAGE FROM THE ELK GROVE PARK DISTRICT TO THE VILLAGE OF ELK GROVE (PUBLIC WORKS WEST GARAGE) WHEREAS, the Village of Elk Grove Village and the Elk Grove Park District are municipalities as defined in the Local Government Property Transfer Act (50 ILCS 605/1 et seq.) ("Act"),the territory of the Village being located partly within and partly without the corporate limits of the Elk Grove Park District; and WHEREAS,the Village of Elk Grove Village ("Village") is a home rule municipality; and WHEREAS,the Elk Grove Park District("Park District") is the owner of a parcel of land for which it has no further use, and which is described in Section 2 hereof; and WHEREAS, it is necessary and convenient for said property to be conveyed to the Village of Elk Grove Village for use in connection with the Village's owning and operating the existing Public Works Facility located at 1635 Biesterfield Road, Elk Grove Village, Illinois, 60007. NOW, THEREFORE,be it ordained by the Mayor and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, State of Illinois, as follows: Section 1: That it is necessary and convenient for the Village of Elk Grove Village to hereafter own, use, and occupy the real estate described in Section 2 hereof solely for Village purposes in connection with the Village's Public Works Facility. Section 2: That the Village of Elk Grove Village will accept conveyance of the following described parcel from the Elk Grove Park District, subject to conditions and covenants of record, private and public easements, drainage ditches, tiles and lateral feeders, if any: See Exhibit'A' Attached Hereto And Incorporated Herein. PIN: 07-36-108-038-0000 Address: 1635 Biesterfield Road, Elk Grove Village, Illinois 60007 Section 3: That the Deed from the Elk Grove Park District to the Village of Elk Grove Village conveying the Park District's interest in the property described in Section 2 of this Ordinance shall include provisions releasing and terminating all rights pursuant to the Public Works Facility Agreement dated September 23, 1980; and the Agreement dated July 8, 2004, previously entered into by the Village of Elk Grove Village and the Elk Grove Park District. Section 4: That the Village may accept a conveyance of the property described in Section 2 of this Ordinance on the above and foregoing terms, provided the Park District has adopted the necessary authorizing Resolution as contemplated by the Act. Section 5: That the Mayor and Village Clerk, along with the Village Manager, be and are hereby authorized and directed to take such steps and execute such documents as shall be necessary or advisable to accomplish the intent of this Ordinance. Section 6: That any ordinance, resolution, rule, regulation, or policy of the Village in conflict or inconsistent herewith is hereby expressly repealed to the extent of such conflict or inconsistency. Section 7: That this Ordinance shall be in full force and effect from and after its date of passage and approval according to law. VOTES: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 1411 day of March 2017.
