HomeMy WebLinkAboutPLAN COMMISSION - 02/04/1981 - IN HOME DAY CARE � • i Minutes Elk Grove Village Plan Commission Wednesday, February 4, 1981 The regular meeting of the Plan Commission was called to order at 8:00 p.m. on Wednesday, February 4, 1981 in the Multi-Purpose Room of the Municipal Building, 901 Wellington Avenue. MEMBERS PRESENT: MEMBERS ABSENT: Kenna, Edward W. , Chairman Geinosky, Frederick C. Cummins, Leah, Secretary Glass, John R. STAFF PRESENT: Mullen, George E. Stephen M. Feller, Paliganoff, David J. Administrative Assistant Stangeland, Orrin J. Docket 81-1: Text Amendment Concerning In-Home Day Care Centers The Plan Commission considered the petition of the Village of Elk Grove Village for a Text Amendment to Article 5 of the Elk Grove Village Zoning Ordinance which would read, as follows: Section 5.27: CONDITIONAL USES IN ALL RESIDENTIAL DISTRICTS A. In-Home Day Care Centers, provided that such Centers are duly licensed with the State of Illinois and with the Village of Elk Grove Village. Kenna suggested that the Plan Commission first consider the appropriateness of permitting in-home day care centers in residential districts. There was unanimous agreement among Plan Commission members that in-home day care centers should be made a conditional use in all residential districts. Kenna noted that the Village Attorney had recommended that a definition for in-home day care centers be added to the Zoning Ordinance. The Village Attorney suggested that in-home day care centers should "mean any family home in which two or more children, not of common parentage, are received for care during the day, provided that such centers shall be limited to a maximum of eight children, which number shall include the family's natural or adopted children under age sixteen and those children who are in the home under full time care". Glass asserted that the definition should specify that a home is considered a day care center when children are received for care "for compensation". Cummins expressed the opinion that the definition proposed by the Village Attorney was poorly worded and not understandable. A motion was made to recommend that the Zoning Ordinance be amended, as follows: • Plan Commission Minutes - 2 - February 4, 1981 Docket 81-1 (continued) Section 9.12 DEFINITIONS In-Home Day Care Center Any family home in which two or more children, not of common parentage, are received for care during the day, provided that such Centers shall be limited to a maximum of eight children, which number shall include the family's natural or adopted children or other children resident in a home under age sixteen. The Secretary called the roll and the following responded 'AYE' : Mullen, Paliganoff, Stangeland, Kenna; 'NAY' : Cummins, Glass; whereupon the Chairman declared the motion carried. Kenna then suggested that the Plan Commission consider the conditions upon which a home can be used as a day care center. Mullen stated that he did not believe that the Village should license in.-home day care centers. Paliganoff agreed with Mullen, and stated that Village licensing would be a double regulation on day care operators. Stangeland commented that the lack of complaints about State licensing procedures indicates that there is not a need for Village licensing. Cummins remarked that parents are in a better position than a local inspector to determine whether or not a home is adequate for care of children. Cummins added that local inspectors would impose on the serenity of the home environment. Kenna pointed out that without local licensing, the Village will only be able to respond to problems by referring complaints to the State. Kenna also questioned the ability of the State Department of Children and Family services to adequately inspect the in-home day care centers. Glass commented that local licensing is needed to insure the protection of children. A motion was made to recommend that the Zoning Ordinance be amended, as follows: Section 5.27 CONDITIONAL USES IN ALL RESIDENTIAL DISTRICTS A. In-Home Day Care Centers, provided that such Centers are duly licensed with the State of Illinois.
