MINUTES
ELK GROVE VILLAGE PLAN COMMISSION
May 24, 1976
The regular meeting of the Plan Commission was called to order
at 8: 12 p.m. in the Council Chamber of the Municipal Building, 901
Wellington Avenue.

Docket 76-3: Special Use Permit - Elks
The hearing was called to order at 8:12 p.m. Walter Niese
was present to represent the Elks for the 5th renewal of the Special
Use Permit. Mr. Niese stated that there has been no problem with
parking arrangements.
Permission from adjoining property owners for use of their
parking facilities, should additional parking be necessary, will be
supplied to the Commission in letter form.
Cummins moved to approve the special use permit. Jacobsen
seconded the motion. All present voted "AYE".
Special Meeting
The Chairman called for a special meeting Tuesday, June 1st,
8:30 p.m. to discuss various unfinished business items.
Docket 76-4: Special Use for Restaurant
The hearing was called to order at 8:36 p.m. Wayne Silva
was present to represent the petitioners .
The property is located at the southwest corner of Devon
Avenue and York Road. A family type, sit-down restaurant is planned
with 88 parking stalls and room for 250 seats.
Leo Theodore, a CPA, is of the opinion that a restaurant at
this location would be most successful . Gross sales would amount to
approximately $1 ,000.00 per day. At a minimum, the Village of Elk Grove
Village would receive a minimum of $3,600 per year in sales tax.
James Pappas was called as a witness for the petitioner.
He is an owner of six restaurants in the area. A family-type restaurant
is very successful and would cater well to residents of the Industrial
Park.
Hamilton asked if Mr. Garuilos was owner of Mr. Edwards . He
replied that he was manager for nine years, but no longer has any
interest in the restaurant.

Krasnow questioned if trucks would be allowed and Garuilos
replied "no".
In reply to a question from Klyber, the petitioner intends
to apply for a liquor license. The restaurant would operate, however,
if a license was not issued. A site plan was submitted as an exhibit.
Examples of a family-type restaurant are Lums , Denny's and
Jo Jo's. No entertainment is planned for the proposed restaurant.
They will not create a truck stop.
Hamilton requested input from the Fire and Police Department
on the location and traffic pattern associated with this type of land
use. He felt also that the FAA Airline Pilot Association and the City
of Chicago should be contacted regarding the location of a restaurant
near one of the busiest runways at O'Hare.
Hamilton questioned the number of seats versus parking spaces.
The petitioner replied that they will meet all Village requirements in
regard to seating and parking stalls .
The Chairman stated that the Commissioner will take the
information under advisement. The hearing ended at 9:36 p.m.
Docket 76-5: Del Medico Rezoning
The hearing was called to order at 9:40 p.m. Burton Sherre,
counsel for the petitioner, is requesting a rezoning from B-1 to B-3
to allow the sale of recreational vehicles at 420 East Higgins Road.
Hauser mentioned that the B-3 zoning would allow many more
uses than just selling recreational vehicles . Hauser also asked if
they would consider a Special Use in B-1 .
Rettenbacher stated that there are no special use provisions
for recreational vehicles . This would require a text amendment.
Wesley asked if the petitioner would agree to limit the use
solely to selling of recreational vehicles . The petitioner said that
he would comply acid agree to such a limitation. Shannon stated that
such an agreement could be construed as contract zoning and did not
consider such an agreement as enforceable or advisable.
The Chairman stated that the Commission will take the evidence
under advisement. The hearing closed at 10:05 p.m.
Hamilton moved to approve the B-3 zoning. Klyber seconded
the motion.
The following voted "AYE": Krasnow, Klyber, Hamilton , Cummins ;
"NAY": Jacobson, Wesley, Hauser, Shannon.
Hamilton moved to recommend B-3 zoning to the Village Board
with a limitation to include present uses (tires , part sales , etc.) and
in addition recreational vehicle sales as found under the B-3 definition,
Section 5.62 Uses , Paragraph B, parts 2 and 9. Krasnow seconded the
motion. No vote was taken.
Hamilton added that the Commission would only like the sale
of recreational vehicles .
Hamilton withdrew his motion. Shannon requested the Attorney's
opinion as to how to limit the B-3 zoning to recreational vehicles .

Rountree Property
John Martin presented a landscape plan for the Rountree
property. Unique to the development will be fruit tree plantings .
Also presented was a lighting plan for the development.
The developer will conform substantial to subdivision control regulations
except that 14' wooden poles , rather than 15' wooden poles , will be
used.
Maximum height of the buildings will be 28' . There is no
area on the developer's property where the highest grade will be
greater than 3' above the lowest point on Oregon Trail . There is a
portion of Oregon Trail which is 17" higher than the grade on Oregon
Trail (at foundation level) .
Hamilton suggests that the dry detention pond should have
drain tile and crushed rock. Standards for this are found in the
U.S.G.A. standards . The standards will adequately drain the property
and aid in the prevention of erosion. In addition, six inches of
topsoil should be put back on the property to aid in the retention
of water.
Rettenbacher was requested to contact the lighting firm
for the developer and compare it to the Subdivision Control Ordinance
provisions .
Wesley asked if berms will be included in the landscaping.
John Martin replied that berms are to be provided possibly near the
public roadway areas.
The Engineer will be requested to have the sewage flows
determined for the special meeting and Rettenbacher's report on
lighting.
The meeting adjourned at 12 :00 midnight.
