Zoning Variation—Docket#17-5 522 Brynhaven Street
Chairman Childress called the meeting to order at 7:02 pm and read a statement describing the
hearing notification procedure as well as the legal notice.
The petitioner, Jon Klingbiel, was sworn in and asked to present his case.
Mr. Klingbiel stated that he lived on a unique double frontage lot with a subsequent narrow rear
yard that would not accommodate a fifteen(15') foot diameter pool without pursuing a zoning
variation. He mentioned that his wife had health issues and the pool was intended as a source of
exercise and therapy per the recommendation of her doctor.
Mr. Childress opened the meeting to questions from the board.
Ms. DeFrenza asked the petitioner about the pool fence height.
Mr. Klingbiel indicated that since the height of his existing fence around the yard varied,the
pool will have its own barrier fence mounted on top of the pool structure with an accessible step
ladder capable of being secured.
Mr. Dohrer commented about appropriate site storm water drainage and concluded that he had
no concerns since the site was flat and lower than adjacent neighbors.
Ms. Kelley asked if any neighbors were present.
Mr. Klingbiel presented a favorable written response from his neighbor Mr. Jovanovic, 520
Brynhaven Street,who had no issues.
Mr. Jameel asked about the longevity of the pool.
Mr. Klingbiel responded that the pool was warrantied and was able to be dismantled and
reassembled in a timely fashion if he or future occupants of the residence ever chose to remove
the pool.
Mr. Bookler asked about the pool equipment location.
Mr. Klingbiel responded that the equipment was located near the southwest comer of his
property.
Mr. Childress read written comments from two additional neighbors, not present,who had no
issues with the pool. The neighbors were Mr. & Mrs. Bauer, 81 Wildwood and Ms. Watson, 77
Wildwood.
A motion to DO GRANT a variation for the installation and construction of a fifteen(15') foot
diameter pool located entirely within the required side yard along the west property was made by
Mr. Meister and seconded by Mr. Colgan. Upon voting(AYES—Bookler,Kelley,Jameel,
Larson,Childress,Dohrer, Colgan, Meister,DeFrenza.) The motion to DO GRANT the
variance passed unanimously.
Mr. Childress advised the petitioner, Mr. Klingbiel, to contact the Village Clerk and attend the
subsequent Village Board Meeting. The meeting adjourned at 7:12 p.m.

Dear Honorable Mayor and Board of Trustees:
On July 13,2017 at 7:02 p.m.,Zoning Board of Appeals Chairman,Donald Childress called the
hearing to order.The petition was read as well as the mailing notice statement. Petitioner,Jon Klingbiel,
was sworn in and asked to state his case for requesting a zoning variation.
Section 3-7: D.4 of the Zoning Ordinance prohibits pools from being located within any required
side yard.
The petitioner is seeking a variance to permit the construction of a fifteen (15')foot diameter
pool located entirely within the required side yard along the west property.The pool will be located
approximately eleven (11')feet off of the west property line and thirty-five(35')feet off of the front
property line within his existing fenced yard.The property seeking the variation is located at 522
Brynhaven Street, Elk Grove Village, Illinois
The petitioner stated that due to his wife's current health condition the pool would serve as a
means for exercise and therapy, however,the rear yard was too narrow to construct the pool in that
area due to the current configuration of his double-frontage property.
The following Questions and Comments were brought up by the Commissioners:
1. The Commissioners inquired about the petitioners' pool fence height.
2. The Commissioners commented on appropriate storm water drainage.
3. The Commissioners inquired about input from adjacent neighbors.
4. The Commissioners asked about the pool construction/materials, longevity and warranty.
5. The Commissioners inquired about pool equipment location and existing and new electric
service locations.
Public Comments:
1. Chairman Childress read letters into the hearing from the following neighbors; Mr.
Jovanovic,520 Brynhaven St., Mr.&Mrs. Bauer,81 Wildwood and Ms.Watson, 77
Wildwood. All three were in favor of the variation request.
The chairman called for a motion. Mr. Meister made a motion to DO GRANT the variation for
the new pool which was seconded by Mr.Colgan.A roll call was taken.
The motion to DO GRANT the variation was passed unanimously.
