HomeMy WebLinkAboutORDINANCE - 3506 - 8/15/2017 - 522 Brynhaven pool variation ORDINANCE NO. 3506 AN ORDINANCE GRANTING A VARIATION OF SECTION 3-7:1)(4) OF THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION OF A FIFTEEN (15') FOOT DIAMETER POOL LOCATED ENTIRELY WITHIN THE REQUIRED SIDE YARD AND APPROXIMATELY ELEVEN (11') FEET OFF OF WEST SIDE OF PROPERTY LINE FOR PROPERTY LOCATED AT 522 BRYNHAVEN STREET ELK GROVE VILLAGE WHEREAS,the Zoning Board of Appeals, at a public hearing duly called and held according to law, considered the question of granting a variation of Section 3-7:1)(4) of the Zoning Ordinance as it pertains to permitted locations of pools in residential zoning districts to permit the construction of a fifteen(15') foot diameter pool located entirely within the required side yard and approximately eleven (I P) feet off of west side property line for property located at 522 Brynhaven Street; and WHEREAS,the Mayor and Board of Trustees of the Village of Elk Grove Village find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE,BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 3-7:1)(4) of the Zoning Ordinance to permit the construction of a fifteen (15') foot pool located entirely within the required side yard and approximately eleven(11') feet off of west side of property line at 522 Brynhaven Street and identified by property identification number: 08-21-414-028-0000. Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 4 NAYS: 0 ABSENT: 2 PASSED this 15th day of August 2017.
