Authorization of a request from Queen of the Rosary Parish to waive fees for a temporary Class A Liquor License and a Food Caterer's License in the amount of$3,000 for the Parents Club Fall Fest on Sunday, October 29, 2017 at 750 Elk Grove Boulevard. (The fee for a Class A Liquor License is $2,900 and the fee for a Food Caterer's License is $100. (It has been past practice of the Village Board to grant fee waivers for governmental and non-profit organizations. (The Village Clerk recommends approval.) b. Consideration to award a professional services contract with HR Green of McHenry, IL for the Phase I Preliminary Engineering&Phase II Final Engineering for the Beisner Right of Way (ROW) Storm Sewer Removal and Replacement in the amount of$59,390 from the Water& Sewer Fund. (A proposal for professional design engineering services was solicited from HR Green of McHenry, IL to develop contract plans, specifications, and complete permitting tasks for the Beisner ROW Storm Sewer Removal and Replacement project. (The scope of the project includes the removal and replacement of approximately 1,800 linear feet of existing 48" and 54" Corrugated Metal Pipe storm sewer located within the vacant right of way of Beisner Road. (Adequate funds are available in the Water& Sewer Fund. Page 1 of 7 (The Director of Public Works has recommended approval.) c. Consideration to award a professional service contract with WBK Engineering, LLC for the Clearmont Pedestrian Bridge Over Salt Creek for Phase I Engineering in the amount of $103,185.08 from the Capital Projects Fund. (A proposal was solicited from WBK Engineering, LLC of St. Charles,IL for Phase I Engineering Services for the Clearmont Pedestrian Bridge Over Salt Creek. (Included in this Phase I Engineering scope of work will be a Project Development Report (PDR), Bridge Condition Report(BCR), Environmental Survey Request (ESR), stream hydraulic analysis, Preliminary Bridge Design &Hydraulic Report(PBDHR) including Type, Size and Location drawing(s) (TS&L),permitting coordination, comprehensive subsurface geotechnical investigation, and supplemental survey that includes topographic, stream, wetland and right-of-way survey. (WBK Engineering has successfully completed design of various pedestrian enhancements throughout northern Illinois and are qualified to perform the proposed scope of services. (The Director of Public Works has recommended approval.) d. Consideration to award a professional services contract to Nicholas &Associates, Inc. of Mt. Prospect, IL to act as Construction Manager and Constructor for design, architectural drawings, trade bidding, permitting, supervision of demolition and construction for renovations at the James Paul Petri Public Works Facility (450 E Devon Avenue) for a total contract amount not to exceed $ 2,353,105 from the Capital Projects Fund, in the amounts designated as follows: • Pre-construction services at no cost; • 3.75%of the actual construction cost for construction services ($698,560); • 6.50% of the actual construction cost for architectural&engineering services ($1,210,835); and • A fixed General Conditions budget($443,710). (This agenda item includes professional services associated with the construction of the James Paul Petri Public Works Facility. (Nicholas &Associates prepared all of the drawings and bid documents, reviewed the bid submissions, and is prepared to perform the construction management services. (The Village Board approved the professional services contract with Nicholas & Associates at the February 28, 2017 meeting to act as Construction Manager and Constructor. This represents a project identification exhibit. (The Director of Public Works recommends approval.) e. Consideration to award a professional service contract to Nicholas&Associates of Mount Prospect, IL to administer various construction contracts with the lowest responsive and responsible bidder in each of twelve(12)trades packages and reimbursable expenses for the construction of the James Paul Petri Public Works Facility (450 E Devon Avenue) in an amount not to exceed $19,388,059 from the Capital Projects Fund. (On Wednesday September 27, 2017 sealed bids for the renovation of the James Paul Petri Public Works Facility were opened. Page 2 of 7 (The bid document consisted of 12 packages for various trades and several alternates. (Nicholas&Associates, the Village's Construction Managers, have reviewed the bids and discussed the project with the lowest responsive and responsible bidder for each of the trades packages to ensure the completeness of the bids and recommends awards to the lowest bidders. (HR Green,the consultants acting as the Village's/Owner's representative, has reviewed the bids and alternates with Village staff and concurs with Nicholas&Associates recommendations to award to each of the lowest bidders in the respective packages based upon their bid submitted. (The Director of Public Works recommends approval.) f. Consideration to adopt Ordinance No. 3518 amending Title I, Section 1-7A-6.I(Village Manager's Powers & Duties) of the Village Code of the Village of Elk Grove Village. (This amendment provides an increase in the bid threshold for the Village Manager's authorization and the Purchasing Policy. (The previous threshold was up to $20,000 maximum. (State Legislation recently increased the maximum threshold to $25,000. (The Director of Finance recommends approval.) g. Consideration to adopt Resolution No. 51-17 approving the Plat of Resubdivision identified as Arrow Road Construction at 1445 Oakton Street. (This item was discussed at the Judiciary, Planning and Zoning Committee Meeting on Tuesday, September 19, 2017 and was recommended for approval. (The purpose of the Resubdivision is to resubdivide the property at 1445 Oakton Street from two (2) lots into one (1) lot. (This item was discussed at the Village Board Meeting on September 26, 2017 and currently appears under Unfinished Business.) h. Consideration to adopt Resolution No. 52-17(attached)authorizing the Mayor to execute a Letter of Receipt stipulating the terms of an agreement for an application seeking a Cook County Class 6B Property Tax Exemption status pursuant to the Cook County Real Property Classification Ordinance as amended February 15, 2006 for certain real estate located at 2001 Arthur Avenue. (The Law Offices of Liston &Tsantilis, on behalf of their client CH Realty/Acquisitions VII, L.L.C. (Applicant)doing business as Maman Corporation is seeking a Cook County Class 6B property tax exemption for property located at 2001 Arthur Avenue. (The Applicant intends to purchase the existing building and demolish it for the construction of a new state-of-the-art 79,236 square foot industrial building. The existing site contains a functionally obsolete fifty-year old 126,537 square foot building. (The Applicant intends to lease the new facility to an industrial user for manufacturing, warehousing, and or distribution. (The new building will cost approximately $3,508,717 to construct and will create approximately one-hundred construction jobs. (The goal of Class 6B is to attract new industry, stimulate expansion and retention of existing industry and increase employment opportunities. The eligibility requirements for Page 3 of 7 6B status are new construction, substantial renovation or buildings that have been vacant for a period of time. This site qualifies as it involves new construction. (Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The assessment schedule is 10%of fair market value for ten years then 15% in the eleventh year and 20% in the twelfth year. Industrial property is currently assessed at 25%of fair market value in Cook County. (The Director of Business Development and Marketing recommends issuing a Letter of Receipt.) i. Consideration to adopt Resolution No. 53-17(attached)authorizing the Mayor to execute a Letter of Receipt stipulating the terms of an agreement for an application seeking a Cook County Class 6B Property Tax Exemption status pursuant to the Cook County Real Property Classification Ordinance as amended February 15, 2006 for certain real estate located at 83-85 Gordon Street. (The Law Offices of Sarnoff& Baccash, on behalf of Black Eagle Group LLC., (Applicant) is seeking a Cook County Class 6B Property Tax Exemption for 83-85 Gordon Street. (The subject property consists of an approximately 9,000 square foot building that has been vacant since January of 2017. (Black Eagle intends on occupying the entire building and use it for the distribution and warehousing of products for the construction industry. (Black Eagle currently leases space in Elk Grove Village at 225 North Arlington Heights Road where it employs five people. Due to business expansion, Black Eagle will purchase the new building, move its entire operation to the new location, and hire an additional eight employees (The Applicant intends on spending $175,000 to improve the building. Improvements include; replace and add exterior lighting, Install a new back lit sign, upgrade landscaping, install new roof over dock, install new windows, install new coping, repair drive in door, upgrade fagade per application packet, rebuild ramp to loading dock, install new aprons per Village code, replace and reconstruct and stripe parking lot, replace and reconstruct side driveways, and complete interior renovations. (The goal of Class 6B is to attract new industry, stimulate expansion and retention of existing industry and increase employment opportunities. The eligibility requirements for 613 status are new construction, substantial renovation or buildings that have been vacant for a period of time. This site qualifies as it involves vacancy for less than twenty-four(24) months with a purchase for value, and significant rehabilitation. (Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The assessment schedule is 10%of fair market value for ten years then 15% in the eleventh year and 20% in the twelfth year. Industrial property is currently assessed at 25%of fair market value in Cook County. (Upon approval,the Director of Business Development and Marketing will issue a Letter of Receipt to the Applicant. The Letter of Receipt will allow the Applicant to file an application with Cook County. Final approval is at the discretion of the Village Board and contingent with the Applicant completing the improvements stated in their application. (The Director of Business Development and Marketing recommends issuing a Letter of Receipt.) j. Consideration to adopt Resolution No. 54-17 (attached) authorizing the Mayor and Village Clerk to execute an Intergovernmental Agreement between the Illinois State Toll Highway Page 4 of 7 Authority and the Village of Elk Grove Village. (This Intergovernmental Agreement is for improvements for Illinois Tollway Agreement #2017-22, is to document the transfer of right-of-way from the Village to the Illinois Tollway, and from the Illinois Tollway to the Village required as part of multiple Illinois Tollway construction contracts. (The Village owns the right-of-way associated with Rogers Pond located along the future Western Access Corridor between Pratt Boulevard and Touhy Avenue on which the northern leg of the Elgin O'Hare project is to be constructed and maintained, and for the purpose of implementing the project is required to be transferred to the Illinois Tollway. (The Tollway will also agree to perform drainage improvements as part of the Elgin O'Hare Western Access project that will improve the Rogers Pond detention and flow characteristics. (The Village also maintains jurisdiction of Lively Boulevard north of North Thomdale Avenue, and the Illinois Tollway is seeking to transfer parcels to the Village for the Village's ultimate maintenance and jurisdiction of Lively Boulevard. (In addition, execution of this agreement will provide for the Tollway to relinquish it Right of First Refusal to the parcels located at the 1-90 and Arlington Heights Road interchange. Consideration to waive formal bidding requirements and award a professional service contract to Grundfos Water Utility, Inc. of Aurora, IL to furnish two replacement pumps and accessories for the Residential Lift Station in the amount of$64,000 from the Water& Sewer Fund. (A proposal was solicited from Grundfos Water Utility, Inc. of Auroa, IL to furnish two replacement pumps and accessories including guide rails, brackets and discharge elbows for replacement of two pumps at the Residential Sanitary Sewer Lift Sation. (The Residential Lift is planned for a rehabilitation project;this would be the first step in this project to replace deteriorated components and pumping equipment. Grunfos was selected as the manufacturer of the pumps based upon design, materials,references from other municipal customers and the pumps are manufactured in Aurora, Illinois. (This project has been planned and budgeted in the Water& Sewer fund. (The Director of Public Works recommends approval.) 1. Consideration of a request to hold a Public Hearing before the Plan Commission to consider the petition submitted by the Village of Elk Grove for text amendments to the Zoning Code. (A Petitioner is seeking a text amendment to Zoning Ordinance, Section 713-5-2:13. Permitted Uses by adding "Health and Fitness Centers with ancillary services including tanning and hydromassage". (This type of permitted use will complement existing uses within the B-5 district and provide an opportunity for redevelopment of vacant space. (The Village is seeking an additional text amendment to Zoning Ordinance, Section 7B-5- 2: B Permitted Uses by deleting "and none other" from the first sentence and adding "Village Board Approved Uses" to the list of permitted uses. (This amendment will allow the Village Board to approve prospective uses in a timely manner and allow the flexibility of permitting compatible uses for the B-5 Zoning District without further text amendments. (A date for the Public Hearing has not been scheduled.) Pagel of 2 m. Consideration to increase the FY 2016-17 Busse Elmhurst TIF Fund in the amount of $14,421,000 to allow the General Fund, Business Leaders Forum Fund, and the Water Sewer Fund capture reimbursement of TIF eligible expenses. (The increase in the Busse Elmhurst TIF Fund is necessary to reimburse the expenses paid from the other funds prior to closing the fiscal year 2016-17. (Reimbursement is expected when future TIF tax revenue is received. (The expenses have been reviewed by Counsel and by the Auditors. (The Director of Finance recommends approval.)
