HomeMy WebLinkAboutPLAN COMMISSION - 08/15/1974 - YANKEE DOODLE DANDY SPECIAL USE Minutes ELK GROVE VILLAGE PLAN COMMISSION August 15, 1974 The public hearing of the Elk Grove Village Plan Commission was called to order by Acting Chairman Mark Grice at 7:35 p.m. on Thursday, August 15, 1974 in the Council Chamber of the Municipal Building. Richard McGrenera acted as Secretary and swore in all those wishing to testify. MEMBERS PRESENT: Mark Grice Al Krasnow Richard McGrenera Edward Hauser Joseph Cimino William Wesley (arrived 8: 10 P.M.) STAFF PRESENT: Thomas Rettenbacher, Building Commissioner Jan Lewis , Administrative Intern Public Hearing - Special Use Permit - Yankee Doodle Dandy Ray Courney, Attorney for Eugene C. DiVito, petitioner, spoke on behalf of the proposed special use for a restaurant in an 1-2 District. Eugene C. DiVito and William Price, Executive Vice-President of Yankee Doodle Dandy, also testified and answered questions from the Plan Commission. They informed the Commission that the building would be identical to the Yankee Doodle Dandy restaurants in neighboring communities . The proposed all-brick building is approximately 2,500 square feet on approximately a one acre piece of property. The present plan shows 90 parking spaces . The hours of the restaurant would be approximately 10 A.M. - 10 P.M. There would be 25 employees and an estimated $300 - $350,000 sales/year. According to Mr. DiVito, a tentative agreement has been made with the State of Illinois for removal of the 4" high median strip (a copy of that agreement is attached to the minutes). Mr. DiVito has agreed to provide fire hydrants no farther than 300 feet from any portion of the building. The public hearing adjourned at 8:02 P.M. with no remarks from the audience. Public Hearing - Rock Road Construction Company Annexation The public hearing for the proposed annexation of the Rock Road Construction Company was reconvened by Acting Chairman Grice at 8:03 P.M. (continued from 7-18-74) . A letter from Richard Ungaretti , Attorney representing Rock Road Construction Company was read requesting the petition for annexation be withdrawn. The public hearing was then adjourned. Public Hearing - Petition for Rezoning Northwest Corner of Highway 83 and Greenleaf Avenue The public hearing of the petition of J . L. Williams and Company, Inc. for the rezoning of the northwest corner of Highway 83 r • • NW Corner of Highway 83 & Greenleaf (continued) and Greenleaf Avenue was called to order by Acting Chairman Grice at 8:22 P.M. The rezoning request is for a change from 1-2, General Industrial District, to B-2, Business District , which includes retail shops . James Dana, Attorney representing J . L. Williams and Company, Inc. spoke on behalf of the petitioner. He stated owners of neighboring property had been informed by letter on August 5, 1974 of the petition for rezoning and no objections had been voiced. He also stated this property was at one time zoned B-2. Fred Hart, of the Architectural firm, Meyer & Hart also spoke on behalf of the petitioner and also answered questions from the Plan Commission. The petitioners explained they plan to erect adequate parking, provide water detention on the roof and parking lot , landscape, and use face brick. The plan shows approximately six to eight stores which might include professional offices, a sandwich shop, currency exchange, barber shop, and laundromat. There are presently no facilities of this nature in the Industrial Park. The amount of parking was questioned and the petitioners stated they would comply with the parking required. The placement of refuse was questioned and the petitioners stated indoor storage would be provided. They also stated they would comply with the fire requirement, and the storm water detention requirement. The width of the access drives was also discussed. The Building Commissioner indicated these differences could be resolved when application is made for building permits. The public hearing recessed at 8:45 P.M. and was reconvened at 9:06 P.M. when questions and comments from the audience were invited. There being none, the hearing adjourned at 9:07 P.M. Correction to the Minutes of August 1 , 1974 Please correct your minutes to record Cimino and Krasnow opposed to the motion described below: Robert Stucker, Attorney representing the homeowners opposed to the funeral home (Mr. and Mrs . Norman Denbroeder and Mr. and Mrs. Lee Cantrell ) , requested thirty days to study the proposal and submit a brief of law and testimony. He agreed to twenty days for the submittal of his brief with ten days for the opposition to reply to the brief. The vote was five to two in favor of the motion (opposed were Cimino and Wesley) . Higgins Industrial Park Unit No. 158 Because this lot is in the flood plain, the Commission members questioned Joe Cimino about the status of the revised "Flood Control Ordinance". He stated that the Director of Public Works and Engineering has reviewed the Ordinance and presented comments . The next step will be a meeting of the Flood Control Committee. Cimino moved "That Higgins Park Unit No. 156 be approved with the provision that retention be required in accordance with Metropolitan Sanitary District specifications even though the land is less than - 2 - 8/15/74 Plan Commission Higgins Ind. Park Unit #158 (continued) the minimum acres required. Also since it is in the flood plain) that compensatory storage be required to make up for flood plain lost." Seconded by Krasnow. Ayes : Grice, Cimino, Krasnow, Wesley, McGrenera. Nay: Hauser. Higgins Industrial Park Unit No. 157 (This lot is not in the flood plain.) Krasnow moved "That Higgins Industrial Park Unit No. 157 be approved." Seconded by Hauser. Ayes : Grice, Cimino, Krasnow, Wesley, Hauser, McGrenera. Nay: None. Elk Grove Enterprise One Resubdivision (Mayfair Industrial Park) (This is not in the flood plain.) Wesley moved "That Elk Grove Enterprise One Resubdivision be approved." Seconded by Cimino. Ayes : Grice, Cimino, Krasnow, Wesley, Hauser, McGrenera. Nay: None. Pecora Oil Annexation Zoning Request Ted Pecora submitted a request for an informal discussion with the Plan Commission for Office-Transitional zoning for his 4.9 acre property located south of Higgins Road and east of Wildwood Road. It was decided that an informal meeting could be held in the third or fourth week of September. The staff will arrange such a meeting. Discussion A brief discussion was held concerning the upcoming meeting with the Village Board on Thursday, August 22 at 8 P.M. All members present at the August 15 meeting plan to attend the August 22 meeting. The meeting adjourned at 10:08 P.M. Submitted by: Janet K. It appears that a portion of the existing barrier median east. of the left turn bay for Landmeier Road could be removed and replaced with an M2 .12 cross-section. Upon submittal of a plan showing the- proposed commercial development' on the north side of Higgins Road, the drive�vrays and parking pattern, " we can better determine the feasibility and extent of the afore- mentioned revision.
