HomeMy WebLinkAboutORDINANCE - 3527 - 11/14/2017 - Sale of Cigarettes to Minors from eighteen to twenty one ORDINANCE NO. 3527 AN ORDINANCE AMENDING SECTION 3-611-1 AND SECTION 3-6114 OF THE VILLAGE CODE BY AMENDING PROVISIONS CONCERNING AGE REQUIREMENTS FOR THE SALE OF CIGARETTES TO MINORS FROM EIGHTEEN TO TWENTY-ONE WHEREAS,the Village of Elk Grove Village is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS,the Village regulates the retail sale and purchase of tobacco products, accessories and electronic smoking devices to persons under eighteen (18) years of age pursuant to Section 3-613-1 and Section 3-6134 of the Village Code of Elk Grove Village; and WHEREAS,recent studies indicate that 95 percent of all adult smokers started smoking before they turned 21 years old; and WHEREAS, studies also indicate that people who begin smoking at an early age are more likely to develop a severe addiction to nicotine than those who start at a later age; and WHEREAS,rates of tobacco and e-cigarette use have decreased significantly in jurisdictions for which the minimum sales age for tobacco products has been increased to 21 years; and WHEREAS,the Mayor and Village Board has determined that it will serve and advance the public's health, safety and welfare and be in the best interest of the Village and its residents, to amend the Village Code of Elk Grove Village to increase the minimum age for the purchase and sale of tobacco products and electronic smoking devices to twenty-one (21) years of age. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: The foregoing recitals are hereby adopted and incorporated into and made a part of this Ordinance as if fully set forth herein. Section 2: That the Definition of Minors set forth in Section 3-613-1 of the Village Code be amended to read as follows: MINORS: Any person twenty (20) years of age or under. Section 3: That any reference to the age of Minors set forth in Paragraphs 1, 2, 3, 4, and 5 of Section 3-613-4 of the Village Code be amended from eighteen(18) years of age to twenty- one (21) years of age. Section 4: That Section 3-613-413.6 be amended to read as follows: Sales: It shall be unlawful for any person seventeen (17) years of age or younger to sell tobacco products or alternative nicotine products. Section 5: That any person who violates any of the provision of this Ordinance shall be subject to a fine of not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense. Section 6: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 7: That this ordinance shall be in full force and effect from and after January 1, 2018, and publication in pamphlet form according to law.
