Oakton Chuck Byrum presented revised materials regarding the text amendment for a special use in the I-1 district, consisting of: 1) an addition to the text amendment to address bulk regulations; 2) a definition of "light assembly," 3) a definition of "waste materials," and 4) revisions to the Amendment to the Annexation Agreement regarding setbacks, landscaping and the site plan. Copies of a letter from Patrick Lucansky (attorney representing Carroll Square owners) and copies of a letter from Chuck Byrum to Mr. & Mrs. Parker were presented (attached to these minutes) . Fred Geinosky inquired about other areas of the Village which might be affected by the text amendment, and about precedent for I-1 uses next to residential areas. The Pecora property (S. side of Higgins Road, E. of Wildwood Road) , currently unincorporated, could seek annexation and O-T zoning and this Special Use. The Perrie Grove Apartments are located adjacent to an I-1 District. Mrs. Parker, a resident at 631 E. Oakton, noted: 1) that John Gullo had gone to great efforts to satisfy the surrounding property owners; 2) that she opposed spot lighting in the manner Gullo has on his buildings on Lively Blvd. ; and 3) that the Plan Commission and staff Minutes PLAN COMMISSION December 16, 1987 -2- have done a good job in addressing residents' concerns. John Glass recommended that the conditions listed in the Amendment to the Annexation Agreement expire in six years and therefore should be listed as conditions in the Special Use Permit. A motion was made by George Mullen to recommend approval of the text amendment with the following changes: 1) Make paragraph A Prohibited Uses; 2) re-letter paragraphs A, B, C to B, C and D; 3) Change condition 3 to read: "It shall be screened or landscaped in a manner approved by the Plan Commission, which may exceed the zoning requirement. " The motion was seconded by Leah Cummins and passed unanimously. Dave Paliganoff made a motion to recommend approval of a Special Use Permit with a Site Plan as revised and approved by Village staff and contingent upon meeting all conditions and requirements in the Annexation Agreement and any amendments. The motion was seconded by Phil Knudsen and passed unanimously. NORTHWEST POINT: Text Amendment to Office-Park District Others Present: Lynn Jones, Metropolitan Life Insurance Co. Don O'Healy, Metropolitan Life Insurance Co. Donna Pugh, attorney Jim Graveel, Parking Expert Donna Pugh presented a revised request for variations: 1) to calculate the required number of parking spaces based on one per each 300 sq. ft. of floor area versus the current 250 sq. ft. requirement; 2) to add a subsection to Section 5.74-40 for parking areas servicing buildings in which 85% or more is devoted to office use, to permit 60% of the spaces to be 9' x 18' and 40% of the spaces to be 8'6" x 16' ; and 3) permits 70 0 angle parking per an exhibit G. Staff comments were reviewed and arrangements were made for Jim Graveel to meet with the Village Engineer and the Building Commissioner to discuss calculation formulas in determining aisle widths for 700 angle parking. Donna Pugh reiterated Metropolitan Life's reasons for the petition being: 1) in accordance with expert recommendations; and 2) in comparison with the requirements of other area communities. The possibility of permitting fewer spaces to be built initially, with a reserved area for additional parking should the Village determine the need existed, was analyzed. Also, as you know, we have successfully completed the mutually agreeable documents and they have been presented to your Plan Commission at a public hearing held on November 4 , 1987 . At the direction of the Carol Square HomeownersJAssociation and on their behalf,. we strongly urge the Village Board . to give favorable consideration to the mutually agreeable first amendment to Annexation Agreement and the O&T/Transitional District and that you approve both of these matters. Parker 631 East Oakton Elk Grove Village, Illinois 60007 Re: Gullo Special Use Dear Mr. and Mrs. Parker: Enclosed herewith you will find a revised Site Plan and Landscaping Plan for the Gullo property which Mr. Gullo has prepared since the public hearing before the Village Plan Commission meeting. I call your attention to the westerly end of the front of the building which will be constructed across from your home on the west side of Stanley Street. In addition to the berm, some additional landscaping has been added which will provide for screening of parking spaces immediately to the west of the building. You should also know that the proposed Amendment to the Annexation Agreement is being modified to provide that no uses will be made of the buildings constructed within the Special Use (other than uses which are permitted in the O-T District or Office Uses) including, traffic, between the hours of 10: 00 P.M. 'and 6: 00 A.M. In addition, the Village will have to approve of any Lighting Plan on the fronts of the buildings along Oakton Street. We have tried to be responsive to the concerns you expressed, and I hope that you will agree that we have done a good job. We feel that the Special Use and the provisions in Mr. & Mrs. Fredrick A. Parker December 11, 1987 Page - 2 - the Annexation Agreement with respect to the development of this property will give Mr. Gullo a reasonable opportunity to develop the property, and at the same time, take into consideration the interests of the neighborhood.
