Chairman Glass called the meeting to order at 7 : 43 P.M.
The public hearing on Docket 88-8 was opened at 7 : 45 P.M.
DOCKET 88-8 Fence Regulations
Staff Present: Tom Rettenbacher, Earle Kracht, Robin Weaver,

Others Present: audience of 73 persons and two reporters
George Knickerbocker, the Village Attorney, presented the
petition from the Judiciary, Planning & Zoning Committee of the
Village Board of Trustees to amend the Zoning Ordinance with
respect to fence regulations . Over fifteen or sixteen years
the Village has received numerous requests for variations for
fences on double and triple frontage lots . A change was made
in 1974 to make the requirements less restrictive for double
frontage, and in 1982 to make the requirements less restrictive
for triple frontage yards .
The reason for a petition to amend the requirements is to
permit residents fuller use of their yards and still maintain
line of sight precautions . Definitions of open and solid
fences were provided (attached) . George Knickerbocker explain-
ed each exhibit to demonstrate current versus proposed
requirements .
Commissioner Knudsen stated his support of the proposal as
it allows residents greater use of their property while still
protecting the public safety. Commissioners Fulton and
Paliganoff asked about the number of residents affected. The
response was that it would potentially affect every corner lot.

Chairman Glass noted that these issues were thoroughly
discussed and debated fifteen years ago. He asked what was
different now. George Knickerbocker responded that at that
time there was a concern about inability to control, and a
concern about public safety. However, line of sight is
incorporated in these proposed requirements . In response to
Chairman Glass ' inquiry, Tom Rettenbacher explained that the
proposed requirements would not permit fences any closer to
sidewalks than is currently permitted.
Mr . Lantz of 100 Parkchester asked why a solid fence couldn' t
go as close to the corner as an open fence. Per George
Knickerbocker the Judiciary, Planning and Zoning Committee and
the Village Board thought it inadvisable, in effect being less
restrictive for chain link than a solid fence, but in each case
providing relief . Tom Rettenbacher reiterated that this proposal
will not make every resident happy--residents can still seek a
variation on an individual case basis .
The public hearing was adjourned at 8 : 46 P.M. Additional
discussion was scheduled for June 1, 1988 .

The Village Attorney stated that he and staff were recommend-
ing some changes to the original petitions . Those changes were
explained. In addition, the three petitions were re-stated.
Chairman Glass explained the purpose and function of the
Plan Commission, and procedures for the meeting. He reiterated
that zoning does not cause flooding and that the issues before
the Plan Commission have no bearing on flooding. He then stated
that annexation would require a public hearing and that drainage
of any property had to be resolved prior to the issuance of any
Village permits for development.
Residents (many of them angry) then were permitted to
address the Plan Commission until they had no further comments .
Their comments addressed flooding.
Additional discussion was scheduled for June 1, 1988 .

SUBJECT: PROPOSED CHANGES TO ZONING ORDIANCE REGARDING
FENCE REGULATIONS
Attached are the proposed changes and adjustments of the Sections
regulating fencing.
We also recommend the addition of the following definitions:
1. Open Fence - An "Open Fence" is a fence including gates
which has, for each one foot wide segment extending over
the entire length and height of the fence, eighty (80)
per cent of the surface area in open spaces which afford
a direct view through the fence.
2. Solid Fence - A "Solid Fence" is a fence including gates
which conceals from view the activities conducted behind it
from adjoining properties, streets or alleys and has less
than eighty (80) per cent of the surface area in open spaces.
