AN ORDINANCE AMENDING SECTION 6-6-2-8 RETAIL THEFT OF THE ELK
GROVE VILLAGE CODE BY INCREASING THE MAXIMUM VALUE OF
MERCHANDISE INVOLVED IN THE RETAIL THEFT FROM FIFTY DOLLARS
($50.00) TO THREE HUNDRED DOLLARS ($300.00)
WHEREAS,the current dollar amount in the Village's Retail Theft Ordinance is fifty
dollars ($50.00) and thus, merchandise valued at more than fifty dollars is prosecuted in the
Circuit Court of Cook County, rather than in the Village's Administrative Adjudication
Proceedings; and
WHEREAS,the Police Department has recommended an increase in the dollar amount
in order to provide more flexibility in retail theft prosecution; and
WHEREAS,the Mayor and Board of Trustees concur with the recommendations of the
Police Department in the increase of the value of the merchandise from fifty dollars ($50.00)to
three hundred dollars ($300.00).
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section l: That Section 6-6-2-8:A-1 RETAIL THEFT of the Village Code be amended
to read as follows:
6-6-2-8: RETAIL THEFT:
A. A person commits the offense of retail theft when such person knowingly:
1. Takes possession of, carries away, transfers or causes to be carried away or
transferred any merchandise with a value of not more than three hundred dollars
($300.00) displayed, held, stored or offered for sale in a retail mercantile
establishment, with the intention of retaining such merchandise or with the
intention of depriving the merchant permanently of the possession, use or benefit
of such merchandise, without paying full retail value of such merchandise.
Section 2: Any person violating any of the provisions of this Ordinance shall be subject
to a fine of not less than twenty-five dollars ($25.00) nor more than five hundred dollars
($500.00) for each offense.
Section 3: The Village Clerk is authorized to publish this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form according to law.
