HomeMy WebLinkAboutPLAN COMMISSION - 07/07/1982 - SOIL EROSION CONTROL Minutes ELK GROVE VILLAGE PLAN COMMISSION Wednesday, July 7, 1982 The joint meeting of the Plan Commission and Judiciary, Planning and Zoning Committee was called to order at 8:25 p.m. on Wednesday, July 7, 1982 in the Multi-Purpose Room of the Municipal Building, 901 Wellington Avenue. Peterson, Village Engineer George B. Knickerbocker, Village Attorney Jon P. Wildenberg, Administrative Assistant Discussion regarding Subdivision Control Ordinance Requirements for Sidewalks and the Comprehensive Master Plan items on the Plan Commission agenda was deferred. Soil Erosion and Sedimentation Control Draft language (attached) providing soil erosion and sedimentation control requirements within the Village of Elk Grove was received. Trustee Hauser noted that soil erosion requirements could be made part of the Subdivision Control Ordinance or as a separate Ordinance in the Municipal Code. Discussion concerning the applicability of a soil erosion ordinance ensued. The draft states that soil erosion requirements shall be applied to residential subdivisions of 3.0 or more acres and non-residential subdivisions of 1.5 or more acres. Peterson stated he would prefer language which encompassed all properties, regardless of lot size, as in the North Cook County Soil and Water Conservation District standards. Peterson further commented that soil erosion and sedimentation control requirements should apply to all vacant land or land which is being reworked. Knickerbocker questioned whether the ordinance should apply to developers, homeowners or both. This aspect of applicability should be addressed in the final language of the ordinance. Knickerbocker further noted that it may be advantageous to place soil erosion and sedimentation control requirements into the Subdivision Plan Commission Minutes - 2 - July 7, 1982 Soil Erosion and Sedimentation Control (continued) Control Ordinance since it is a focal point for the procurement of many approvals by a developer. Knickerbocker suggested that Section B.6 of the proposed ordinance not be made a part of the Subdivision Control Ordinance, but rather be included as a miscellaneous provision in the Municipal Code. Glass pointed out that the time period of 180 days applied in Section B.6 should be reduced. Knickerbocker recommended that language be added to cover persons/ developers who have received Subdivision approval but have not finished final grading. In response to Trustee Hauser, Peterson stated that the Engineering Department could enforce a soil erosion and sedimentation control ordinance and would probably do so on a complaint basis. Peterson added that he would research what other communities in the Salt Creek Watershed Project were doing with respect to soil erosion and sedimenta- tion control requirements and enforcement. The Village Attorney and Village Engineer were directed by Trustee Hauser to create final ordinance language for review by the JPZ Committee. Thoroughfare Report Trustee Hauser reported that, pursuant to advice from the Village Attorney, the Thoroughfare Report is a discretionary item for a Village to establish and maintain; therefore, no research and update of the plan is required at this time. Glass asked that the item be removed from the Plan Commission agenda. Organization of the Zoning Ordinance Trustee Hauser suggested that the proposed reorganization of the Zoning Ordinance be deferred as there are many factors which make the reorganization monetarily and physically difficult at this time. A reorganization may become more feasible with the advent of word processing equipment. It was suggested that the topic be brought up for discussion in 6 months (i.e. , January 1983) . Glass asked that the Parking Regulations and School Property - Change of Use items be removed from the Plan Commission agenda. Conditional Business Use Trustee Hauser directed that copies of Plan Commission Docket No. 77-6 be distributed to the Plan Commission for its review and discussion. Knickerbocker pointed out that the Village is looking for an avenue to promote commercial uses along certain streets in industrial areas. The Plan Commission will try to prepare a recommendation regarding conditional business use zoning on August 18, 1982. Plan Commission Minutes - 3 - July 7, 1982 Subdivision Control Ordinance Requirements for Sidewalks Knickerbocker recommended that the Village first seek voluntary compliance for those areas without sidewalk. As a final resort, the Village may impose a sidewalk tax to effect construction. A great deal of Staff time will be needed to establish those areas to be taxed. Trustee Hauser stated that the JPZ Committee would like to confer with the Village Attorney and formulate a "game plan" concerning construction of sidewalks. DRAFT - 1 April 16, 1982 An Ordinance Amending .Ordinance No. the Subdivision Control Ordinance of The Village of Elk Grove Village to Include Pro- visions For The Control of Soil Erosion and Sedimentation. k'hereas, excessive erosion and sedimentation of soil from areas under- going development endangers the health and safety of highway users; necessitates the costly repair of gulleys and embankments; clogs sewers and ditches and pollutes rivers, lakes and streams; limits the use of waterways for most beneficial purposes; and reduces the channel cap- acity of waterways: Now, Therefore, Be It Ordained by The President and Board of Trustees of The Village of Elk Grove Village, Cook and DuPage Counties, Illinois: A. General 1. Purpose - The purpose of this Section is to diminish threats to public health and safety, reduce property damage and prevent the des- poilation of the enviornment by regulating and controlling the design, construction, use and maintenance of developments and other activities which disturb or break the topsoil or otherwise result in the movement of earth on land situated in the Village of Elk Grove Village. 2. Applicability - Soil erosion and sedimentation control measures meeting the criteria and re- quirements established herein are required for the following: Residential subdivisions having a total area of 3.0 or more acres Non-residential subdivisions having a total area of 1 .5 or more acres B. Design and Operation Standards and Requirements The following rules shall govern the design and construction of land improvements with respect to soil erosion and sedimentation control. DRAFT - 2 April 16, 1982 1 . Soil erosion and sedimentation control measures shall be provided to prevent the transportation of sediment from the site by a storm event of ten-year frequency or less. 2. Unless otherwise approved by the Village Engineer, not more than 50 percent of the total site area shall be exposed at any given time. 3 . The duration of exposure shall be kept to as short a period of time as practical. 4. Prior to commencement of stripping or grading operations; sediment basins, debris basins, desilting basins or silt trays shall be in- stalled and maintained at points of storm- water outflow from the site. 5. Temporary vegetation, or where appropriate, mulching or other non-viable cover shall be used to protect areas exposed during devel- opment. 6. Permanent, final plant covering or structures shall be installed no later than 180 days after completion of final grading of any part of the site. C. Submittal Requirements Accompanying the preliminary plans of the subdivision, there shall be furnished the following information and data, in addition to that required by Section 8.005 of the Subdiv- ision Control Ordinance. 1. Topographic map, drawn at no greater than two-foot contour intervals, portraying clearly the drainage pattern of the area and showing the location of existing structures, utilities, bodies of water, drainage facilities, vegetative cover, paved areas and other significant natural or man-made features on the site and adjacent land within approximately 100 feet of the site boundaries. • e DRAFT - 3 April 16, 1932 2. Development plan showing areas of excavation, grading and filling; proposed contours, fin- ished grades, provisions for storm drainage; and areas to be paved, covered, sodded or seeded, vegetatively stabilized or left un- disturbed. 3. An erosion and sedimentation control plan indicating: a. erosion and sedimentation control measures to be employed throughout all phases of construction and after completion of development of the site b. types of sod or seeding mixture and rate, expected dates of sodding or seeding, ground preparation, type and rate of fertilizer application, and kind and quality of mulching for both temporary and permanent vegetative control measures e C. provisions for maintenance of control facilities d. identification of the person(s) or entity which will have legal respon- sibility for maintenance of erosion control structures and measures after construction of the development is completed. 4. Schedule of site development operations including stripping and clearing, rough grading, building construction, final grad= ing and landscaping. The schedule shall identify the expected date or dates of commencement of clearing, installation of temporary sediment control measures, install- ation of stormwater drainage facilities, street paving, parking lot paving, and planting of permanent vegetative cover. The schedule shall indicate the estimated dur- ation of exposure of cleared areas. r • DRAFT - 4 April 16, 1982 Submittals shall be prepared in accordance with the standards contained in "Procedures and Standards for Urban Soil Erosion and Sedimentation Control in Illinois" prepared by the Northeastern Illinois Soil Erosion and Sedimentation Control Steering Committee dated October, 1981. D. Responsibility This section shall not create liability on the part of the Village of Elk Grove Village or any officer or employee thereof for any condition or damage which may result from re- liance on this section or on any administrative decision law- fully made thereunder. E. Inspections The Village Engineer shall make inspections of the site while construction of the development is in progress. Where it is found by inspection that conditions are not sub- stantially as stated or shown in the approved development plan, erosion and sedimentation control plan, and schedule of site development operations, the Village Engineer may stop further work until deficient conditions are corrected. That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
