Chairman Glass called the meeting to order
ITEM A. DOCKET 90-12
Community Residence Location Planning Act.
Chairman Glass recapped the issues discussed during the public
hearing. In so doing, Chairman Glass noted the 5 points which the
expert witness brought forth.
Commissioner Ayers asked if it would be best to use the Building
Code to limit the number of occupants in a community residence.
Boffice replied that the Building code refers to rooms used for
"sleeping purposes" which might include a family room, recreation room
or basement. By using the building code exclusively, more than 8
developmentally disabled individuals could live in a small or medium
sized house without a Special Use permit would hinder the goal of
"normalization. " Boffice further stated that he would be most
comfortable with primary limitations in the Zoning Ordinance and
secondary limitations under the present Building Code. The consensus
of the Pian Commissions was to leave the restrictions on the number of
residents in the proposed Text Amendment.
The Plan Commission then examined the spacing restrictions between
Community Residences. Chairman Glass noted that the expert witness
suggested reducing the space requirement from 1,320 feet to 1,000 feet
in single-family residential districts. Commissioner Henrici noted
that the spacing should be uniform in single-family districts as well
as multi-family districts. The consensus of the Plan Commission was to
decrease the spacing requirements from 1,320 feet to 1,000 feet in
single-family zoned districts. In addition, the consensus was to
increase the spacing in multi-family districts from 660 feet to 1,000
feet.

Chairman Glass also noted that the expert witness recommended
changing the name of "Small Community Residence" to "Family Community
Residence" and "Large Community Residence" to "Group Community
Residence." The consensus of the Plan Commission was to change those
names as recommended by the expert witness.
Commissioner Geinosky asked how the proposed Text Amendment
compares to other community's plans. Boffice noted that Elk Grove's
plan meets the spirit and intent of the State Law. Some communities are
more restrictive and some less restrictive than Elk Grove Village.
Commissioner Geinosky noted that some Group Homes can be operated
without a license. The consensus of the Plan Commission was to require
Group Homes that can be operated without a license to obtain a Special
Use permit.
Commissioner Ayers suggested amending the definition of "Community
Residence" to include "paid professional staff" as recommended by the
Illinois Planning Council 's definition on page 7 of their August 17, -
1990 publication. The consensus of the Plan Commission was to include
the language in the definition.
Commissioner Henrici moved and Commissioner Ayers seconded a
motion to recommend that the Village Board adopt the proposed Text
Amendment Ordinance with the following changes:
1. The definition of Community Residence be amended
to read: "A single dwelling unit occupied on a
relatively permanent basis in a family-like
environment by a group of unrelated persons with
disabilities, plus paid professional support staff
provided by a sponsoring agency, either living
with the residents on a 24 hour basis, or present
whenever residents with disabilities are present
at the dwelling; and complies with the zoning
regulations for the district in which the site is
located. Community residence does not include a
residence which serves persons as an alternative
to incarceration for a criminal offense, or
persons whose primary reasons for placement is
substance or alcohol abuse or for treatment of a
communicable disease. "
2. The spacing requirements be made uniform
throughout the ordinance by prohibiting community
residences from locating less than 1,000 feet from
other community residences.
3. That the name "Small Community Residence" be
changed to "Family Community Residence" and that
the name "Large Community Residence" be changed to
"Group Community Residence."

4. That language be added to Section 4 requiring
Family Community Residences which can be operated
without a State License to obtain a Special Use
permit.
Upon voting on the motion, all AYES. The motion passed.
ITEM B
Crement & Miller Subdivision
Commissioner Geinosky moved and Commissioner Feichter seconded a
motion to authorize the Chairman and Secretary to sign the plat.
Upon voting, all AYES.
CHAIRMAN'S REPORT
Chairman Glass noted that the next regularly scheduled meeting is
on Thanksgiving Eve.
The consensus of the Plan Commission was to cancel the November
21, 1990 meeting.
Commissioner Ayers moved and Henrici seconded a motion to
adjourn. Upon voting, all AYES.
The meeting adjourned at 9: 10 p.m.
