The meeting was called to order by Chairman Glass at
8 : 05 p.m.
Chairman Glass opened. the hearing for Docket 90-1.
Commissioner Geinosky swore in two witnesses: Tom Walter,
Fairway Property, and Ken Dinkewater, Trust Officer for the
American National Bank.
Tom Walter, the petitioner, discussed the proposed Text
Amendment which would allow B-3 conditional uses on Nerge
Road between Rohlwing Road and Devon Avenue. Because of
roadway improvements and increases in traffic flow, both
Rohlwing and Nerge could be considered major arterials.
Chairman Glass noted that all of the property on Nerge
between Devon and Rohlwing is developed except for the 2
acre parcel the petitioner owns. It was further noted that
all the property along Nerge is zoned B-2 or A-2 .
Commissioner Ayers noted that removing the word
"industrial" from the conditional use paragraph would allow
car washes in all areas of the Village with major
arterials. After some discussion on the definition of a
major arterial, Chairman Glass noted that Conditional Uses
were put into effect in 1983 in order to encourage some
additional uses in the industrial areas. Some concern arose
among the Plan Commissioners regarding the impact of
allowing B-3 Conditional Uses throughout the Village.
Chairman Glass then recognized questions from the
audience. Leo Lenaghan objected to the proposal on the
basis that it might set an adverse precedent. Anthony
(Tony) Bonavolonta, the architect for the SBL P.U.D.
agreement, objected to the proposal on the basis that the
area was zoned B-2 in the P.U.D. agreement.

Chairman Glass stated that both Docket' s 90-1 and 90-2
are inter-related; therefore, the public hearing for Docket
90-1 would remain open while discussion of Docket 90-2 took
place.
The meeting recessed at 8 : 35 p.m. The meeting
reconvened at 8 : 50 p.m.
The Public Hearing for- Docket 90-2 was called to
order. For the record, Chairman Glass noted that ( a)
notice of the hearing was published in the February 6 , 1990
DAILY HERALD; (b) property owners within 300 feet were
notified; (c) the property was posted; (d) evidence of
ownership was on file.
Commissioner Geinosky swore in one additional witness,
Dan Ogleby.
Tom Walter discussed the petition to rezone two parcels
along Nerge Road from B-2 to B-3 . The rezoning of the
corner lot, where the Tasty Dawg is located, is needed to
avoid spot zoning. On the adjoining two acre site, a car
wash would be constructed. The car wash, because it is a
high volume business, would stimulate business in the
existing shopping center.
Dan Ogleby discussed the proposed. site plan for the car
wash. The car wash will have both automatic and self-serve
bays.
In addition, underground heating coils will be
installed in the concrete to eliminate icing in the winter.
The lot is large enough to accommodate many stacking cars.
Chairman Glass entertained questions from the
audience. Leo Lenaghan again gave a presentation. First,
if the project fails, then another B-3 use could come on the
site. Second, the Tasty Dawg shares a common driveway with
Lenaghan' s property and a car wash would draw traffic
through his shopping center. Third, Lenaghan' s shopping
center has a downstream storm sewer system. The Plan
Commission noted that the car wash would recycle water and
would need on-site compensatory storage which would
alleviate any potential for downstream flooding. Third, the
Text Amendment would allow other property on Nerge Road to
build conditional use facilities.
Chairman Glass then entertained questions from the Plan
Commissioners. Commissioner Henrici asked how many feet the
equipment room would extend back into the stacking area.
The room would extend from 7 to 10 feet back.
Commissioner Feichter inquired about the car washes '
hours of operation. The center will be open 24 hours a day,
with peak days being Friday, Saturday and Sunday.

Commissioner Geinosky had a number of questions
regarding the car wash operations. The car wash will be
staffed from 11 to 12 hours per day. The car wash is
basically self-service and protections against vandalism are
in place. The staff will be on the premises to maintain the
facility and mechanical operations. Twelve to 13 boys are
planned for the site with four of those being automatic
servers. Approximately 80 cars can be stacked on the site.
The car wash will not serve large trucks, only autos and
pick-ups.
Commissioner Paliganoff asked if any alternative. Text
Amendment changes were available. Earle Kracht replied that
car washes could be made a permitted use in a B-3 .
The meeting recessed at 10 : 35 p.m. and reconvened at
10 : 45 p.m.
Chairman Glass asked Mr. Walter if he would comply with
Village codes regarding the construction of the car wash.
Walter replied yes, all Village codes would be met.
Chairman Glass then expressed the following concerns:
First, taking the word "industrial" out of the B-3
Conditional Use paragraph. Second, if the business were to
fail, what other b-3 uses might go in. Third, the
residentially zoned property across the street. Fourth, a
landscape plan will be needed for the car wash, and finally,
Mr. Lenaghan' s statements that staff would not allow him to
rezone property, but is allowing Tom Walter to rezone
property.
Both public hearings were closed at 11: 06 p.m.
The requests will come before the Plan Commission for
further discussion on March 7 , 1990
Commissioner Feichter moved and Commissioner Paliganoff
seconded a motion to adjourn.
The meeting adjourned at 11: 10 p.m.
