Dohrer G. Schumm S. Carlson J. Oliveto J. Walz D. Zinnel Absent: D. Childress J. Meister, Sr. Staff. J. Polony, Plan Reviewer, Community Development Zoning Variation — Docket # 10-7 1273 Diane Lane Chairman Kaplan called the meeting to order at 7:00 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Mark Kambourelis, was sworn in and asked to present his case. Mr. Kambourelis indicated he intended to replace his existing fence in the same location. He stated the additional fenced in area provided for existing landscaping, gardening, and a place for the children to play. Mr. Kaplan opened the meeting to questions from the board. Mr. Carlson asked the petitioner if the new fence would be the arched design which is currently present at the existing fence. Mr. Kambourelis indicated the new fence would be a six foot (6') custom dog eared fenced. Mr. Zinnel asked the petitioner how long he had lived in the residence. Mr. Kambourelis indicated he had lived at the residence since 2005. Mr. Oliveto asked the petitioner if any of his neighbors were opposed to the construction of the fence. Mr. Kambourelis indicated he had no knowledge of any of his immediate neighbors being opposed to the location of the fence. Mr. Schumm indicated the location of the fence was the only one of its kind within the neighborhood. He mentioned the extension of the fence to the front of the garage was visually evident compared to the fence location of any immediate neighbors. He asked the petitioner to state a hardship for the fence variation. Mr. Kambourelis indicated the fence would allow for him to keep his existing garden and landscaping. He also mentioned the fenced in area provided privacy and shade for his children to play. Mr. Kaplan opened the meeting to questions from the public. Mr. Mark Johnson, residing at 1269 Diane Lane, indicated he had no problem with the location of the fence and the new fence would have the same design as his existing fence. Mr. Mike Boyd, residing at 1272 Diane Lane, mentioned the location and construction of the fence would not have any adverse effects on the neighborhoods appearance. A motion togrant a variation for the installation of a six foot (6') high, custom dog eared fenced extending fourteen feet (14') beyond the nearest front corner of the principal building located on the adjacent single-family residential lot was made by Mr. Dohrer and seconded by Mr. Oliveto. Upon voting (AYES —Zinnel, Kaplan, Walz, Schumm, and Carlson) the motion to grant the variance passed unanimously. Mr. Kaplan advised the petitioner, Mr. Kambourelis, to contact the Village Clerk and attend the subsequent Village Board Meeting.
