ZETTEK MUNICIPAL BUILDING, 901 WELLINGTON AVENUE ON TUESDAY JUNE 19, 2007 Mayor Craig B. Johnson called the meeting to order at 7:31 p.m. 1. ROLL CALL: Present: Mayor: Craig B. Johnson; Trustees: Nancy J. Czamik, Bart K. Dill, Patton L. Feichter, Samuel L. Lissner, James P. Petri, Chris Prochno Also Present: Village Manager, Raymond R. Rummel: Village Attorney, George B. Knickerbocker; and Village Clerk, Ann I. Walsh A quorum was present. 2. PLEDGE OF ALLEGIANCE INVOCATION Reverend Ho, Pastor Light Bearer Community Church, delivered the invocation. 3. APPROVAL OF MINUTES Motion to approve the minutes of the Regular Meeting held on May 22, 2007 as submitted and dispense with the reading. MOVED: Trustee Petri SECONDED: Trustee Czamik VOICE VOTE MOTION CARRIED 4. REPORT OF THE MAYOR AND BOARD OF TRUSTEES Mayor Johnson invited Christine Smith, Senior Vice President of Retail Banking and Mark Resnick, Assistant Vice President Branch Manager (Elk Grove Village) of the Advantage Bank to join him at the podium. The Mayor talked about the upcoming Alexian Brothers Tour of Elk Grove bike race scheduled on August 12 and 13, 2007. The Mayor announced that Advantage Bank has offered to host a Community Block Party as part of the bike race and noted a special informational newsletter would be sent to all residents with details of the race and the block party. Mayor Johnson announced it is anticipated members of the premier racing team, Team CSC, will participate in this year's race. The Community Block Party will be held at the corner of Ridge and Elk Grove Boulevard on August 12, 2007 following the bike races that day. Ms. Smith and Mr. Resnick stated they felt privileged to be a part of the Alexian Brothers Tour of Elk Grove and revealed that Advantage Bank would be changing its name to the Elk Grove Village Bank and Trust to truly reflect the name of the community. Mayor Johnson expressed his gratitude for the Bank's partnership and community involvement. June 6. 2007 Mayor Johnson, Village Manager Rummel, and former Village Manager Gary E. Parrin attended the retirement dinner for Elk Grove High School Principal Frank De Rosa. June 8. 2007 — Mayor Johnson reported he and Trustee Czamik volunteered at the American Cancer Society's Relay for Life event. 1 VBM 6-19-07 OTB —Mayor Johnson informed members of the audience there would be no further discussion regarding the issue of the Off Track Betting facility coming to the Village. He pointed out that the Board had met twice for discussion. Public comments had been heard at the May 22, 2007 Village Board Meeting. Suggestions and public comments were presented at that meeting and have been taken into account by the Board. Some will be incorporated in the Village's written policy. An Ordinance had been adopted on May 22, 2007 and as far as the Village Board is concerned the issue is over. The Mayor noted the Illinois Gaming Commission had delayed its decision to allow the Elk Grove OTB facility to locate in Elk Grove Village based on complaints presented to them at the Illinois Gaming Commission public meeting. There were complaints regarding the proximity of a day care business to the proposed site and Elk Grove Village's public meeting notice process. Mayor Johnson stated the State Supreme Court ruled in 2002 that it is permissible to locate an OTB facility next to a day care facility. Mayor Johnson noted the Board was well aware of that approval before making any decision. The Mayor noted that articles had been published in the Herald; Elk Grove Times and Tribune featuring the possible approval of Off Track Betting in Elk Grove Village and informing the public of the OTB facility discussion. A notice was posted within the Village, on the website and listed on the Village Board meeting agenda and both meetings were televised on Channel 6 cable T.V. Mayor Johnson repeated there would be no public comments heard this evening regarding the Off Track Betting issue. The Village Board has made a decision. Audience members were told they could talk to the Illinois Gaming Commission if they needed to discuss this further. The Mayor added he took exception to the fact that people who are not from our community are trying to influence what is done in Elk Grove Village. He told them to take care of their own towns. Mayor Johnson asked if any member of the Board would like to present a motion to hear further discussion on the OTB issue. There being no motion presented, the meeting continued. Trustee Prochno announced the winners of the Lions/Lioness Scholarship would be chosen in the near future and awarded at the July 17, 2007 Village Board meeting. I The Memorial Day Ceremony was a beautiful event. Trustee Prochno expressed her gratitude to the volunteers. Village staff, and the pilot of the C47 Bomber who conducted the fly over during the ceremony. Trustee Feichter toured the Salvation Army Emergency Disaster facility on Lively and Pratt on June 16, 2007. The Salvation Army has extended an invitation to all residents to stop by for a tour. The facility will serve a good part of Illinois and part of Northern Indiana. i Trustee Feichter and Nancy Carlson, the Economic Development Coordinator, attended a meeting of the Greater Woodfield Chicago Northwest Convention Bureau. It was announced that Mrs. Carlson has been reelected to the Board of Directors. Trustee Petri mentioned that in his role as President of the Elk Grove Sister Cities Organization, he presented a S 1500 check to Nancy Clarbour of the Elk Grove Food Pantry. Members of Sister Cities just returned from a trip to Termini where three $500 checks were presented to three organizations in that City. Trustee Lissner complimented Trustee Czarnik and the members of the Parade Committee on the excellentparade held last Saturday, June 16, 2007. I 2 VBM 6-19-07 I I Trustee Lissner reported he had attended the Joint Action Water Agency (JAWA) meeting on behalf of the Mayor and pointed out that one item on that agenda had to do with granting a request from the City of Chicago for temporary water service during construction at O'Hare. Trustee Lissner noted he did vote for approval as it was a safety issue but he did make it very clear at the meeting that Elk Grove does not support the project Chicago is working on. Mayor Larson; of Schaumburg; will continue to serve as Chairman and Mayor McCloud; of Hoffman Estates, will serve as Vice-Chairman. 5. APPROVAL OF WARRANT Motion to authorize payment of invoices as shown on the May 31, 2007 Accounts Payable Warrant in the amount of 5457,980.74. CONSENT AGENDA It was moved and seconded that the Consent Agenda of the July 19, 2007 Regular Village Board Meeting be approved as presented. A. Elk Grove Park District/Waive Fees— Grant a request to waive permit fees for the replacement of the lap pool dehumidifier at 1000 Wellington Avenue in the amount of$2,695. B. Lutheran Church of the Holy Spirit/Waive Fees— Grant a request to waive the Village's day care center license fee for the period June 1, 2007 through May 31. 2008 in the amount of$325. C. Queen of the Rosary Church/Waive Fees—Grant a request to approve a temporary Class D Liquor License and to waive the S2,100 fee and all other associated fees for their Annual Parish Picnic to be held on Sunday, June 24, 2007. D. Living Hope Church/Waive Fees—Grant a request to waive permit fees for their new garage/storage located at 777 Meacham Road in the amount of$555. E. Alexian Brothers Medical Center/Waive Fees—Grant a request to waive permit fees for their Ambulatory Care Mall and Bed Tower project located at 800 Biesterfield Road in the amount of$16.310. F. High School District #214/Waive Fees— Grant a request to waive the Vending Machine License Fees for eight vending machines located at Elk Grove High School in the amount of$280. G. Easement Variation/542 Maple Lane—Grant a variation from the Village Code, Section 8-1213-1-11), "Easements* , to permit the construction of a shed, which 3 VBM 6-19-07 will encroach two feet (2') on the southeast part of the five-foot (5') public utility easement. H. Coach's Corner. Elk Crossing Shopping Center— Concur with the prior authorization to allow the placement of four (4) tables each with four chairs, to accommodate outdoor seating in front of the restaurant between May 1 and October 31. 2007. I. Mid-America Towers. Inc.. Naperville. IL—Concur with the prior authorization to waive the formal bidding process and award a construction contract to the lowest proposal for the purchase and installation of a low-profile, 80 foot lattice tower at the southeast corner of the Biesterfield Fire Station; away from the street view in an amount of$17,650. J. Covad Wireless. San Jose. CA— Award a professional services contract for the labor and materials needed to add the Bond Street facility to the Village's wide area network and to modify the network at the Village Hall to accommodate planned construction, in an amount not to exceed $16,515. K. Formal Bidding Process —Concur with the prior authorization to waive the formal bidding process and award a professional service contract to the following organizations: • AT&T, Chicago, IL, as sole source vendor for the relocation of local telephone service at 901 Wellington Ave. from the lower level of the Police complex to the lower level of the Municipal complex in an amount not to exceed $14.540: and • C.A. Riley Electric, Elk Grove Village, IL as the lowest proposal for the trenching, installation and connection of a transformer to the Biesterfield Fire Station in an amount of$50.630. L. Amber Mechanical Contractors. Inc.. Alsip. IL— Award a construction contract for the complete maintenance of all heating, ventilating and air-conditioning equipment (HVAC) for ten (10) Village-owned buildings in an amount not to exceed $58.686. M. Kale Uniform Company. Chicago. IL - Grant a request to waive the formal bidding process and award a purchase contract for twenty-three (23) Protective Apparel Company of America (P.A.C.A.) ballistic vests, Model RTGS2 in an amount not to exceed $12.075. N. Martam Construction. Inc.. Elgin. IL— Award a construction contract for the 2007 Drainage Improvement Project in the amount of$219,152 from the Capital Projects Fund. O. Capital Projects Fund - Approve an increase to the FY 2007-08 Capital Projects Fund in the amount of$3 million to pay for projected costs associated with the Police Department relocation and facility tear-down through August. P. FY 07/08 Budget/Increase—Approve an increase to the Fiscal Year 2008 Budget for the rollover of outstanding encumbrances from Fiscal Year 2007 Budget in a total amount of$9,142,311. Q. Village Code of the Village of Elk Grove Village — Adopt Ordinance No. 3130 entitled; "AN ORDINANCE AMENDING TITLE 8, CHAPTERS 3A, 3B, 3C, 3D, 3E, 3F, AND ADDING THERETO CHAPTERS 3G, 3H, AND 3I OF THE BUILDING ACTIVITY CODE OF THE VILLAGE CODE OF THE VILLAGE OF ELK GROVE VILLAGE. REGULAR AGENDA None BOARDS AND COMMISSIONS 8. CAPITAL IMPROVEME\TTS COMMITTEE - CHAIRMAN PETRI a. Lighting of Rohlwing Road from Biesterfield Road to Devon Avenue—This project is pending. The State insists that Elk Grove street lights cannot be installed and if we use the State lights they must be put in from Rohlwing Road all the way to the toll way. 9. JUDICIARY, PLANNING & ZONING COMMITTEE - CHAIRMA\ LISSN ER Trustee Lissner reported a resident had attended the May Coffee with the Mayor and Board and had raised concerns about single-family rental housing. A copy of an Ordinance dealing with rental housing in Mt. Prospect had been distributed to the Board for their review. Following discussion, the consensus of the Board was to add item a., Single-family Rental Housing Regulations to the JPZ agenda. I 10. PERSONNEL COMMITTEE - CHAIRMAN FEICHTER Meeting Schedule - Chairman Feichter called a meeting of the Personnel Committee on Tuesday, July 3, 2007 at 9:30 a.m. in the Chernick Conference Room. 11. RECYCLING & WASTE COMMITTEE - TRUSTEE DILL I Trustee Czarnik reported a one-day document destruction event would take place on Saturday, June 23, 2007 from 9:00 a.m. to 11:00 a.m. in the Elk Grove High School parking lot. The Solid Waste Agency of Northern Cook County will be on site to shred paper documents for Elk Grove Village residents. There is no cost to the residents. Proof of residency is required. Questions may be directed to the Department of Health and Community Services at 847/37-4240. 12. INFORMATION COMMITTEE - TRUSTEE PROCHNO No report I 5 VBM 6-19-07 I • 13. INDUSTRIAL/COMMERCIAL REVITALIZATION COMMISSION TRUSTEES LISSNER/PETRI d. Lively Boulevard— from Touhv to Devon—This project is currently under construction with work being done on the east side from Touhy to Pratt. e. Devon & Arlington Heights Intersection Improvements—This project will actually be completed in 2009. b. Improvements to the Industrial Well sites— Landscaping is being installed. The Mayor made a request that a letter be sent out to the Commission regarding the bike race. 14. YOUTH COMMITTEE - TRUSTEE PROCHNO The Youth Committee scholarship winners will be chosen soon and awarded at the July 17, 2007 Village Board Meeting. 15. PARADE COMMITTEE - TRUSTEE CZARNIK Trustee Czarmk reported on the Saturday; June 16; 2007 Community Parade. Trustee Czarnik complimented and thanked the bands and units, Public Works; Police Department, and all members of the Parade Committee. Channel 6 and the Parade commentators, Rhett Butler and Scarlet O Hara (George Knickerbocker and Pat Droschak) were given special recognition. Appreciation was extended to the following Parade Sponsors: Just Born Candy Company, Access Printing, Crosstown Electric, Inc., Grove Memorial Chapel, A & H Plumbing & Heating Co., Inc., Little Lady Foods and Bigston Corp., USA. Meeting Schedule—The next meeting of the Parade Committee is Monday. July 2, 2007 at 5:30 p.m. in the Chernick Conference Room. CABLE TV COMMITTEE - TRUSTEES PETRULISSNER Trustee Lissner reported the AT&T Bill had been passed by the State House and Senate to allow AT&T to bring their cable business into the communities without going through the Cable Franchise procedure. Village Attorney; George Knickerbocker; reported that Village Staff is currently reviewing a recently enacted Ordinance of the Village of Barrington concerning the installation of facilities in the Village Right-of-Way. It is anticipated that Staff will recommend that the Board consider the adoption of an Ordinance with similar provisions at the July 17; 2007 Elk Grove Village Board meeting. The Village Attorney noted it is the recommendation of Staff that the Board adopt a motion as follows: (The Mayor explained Elk Grove has always looked forward to cable competition. The problem is that AT&T wants to work by different rules than Comcast. As the Bill was first introduced, AT&T would have been allowed to put a refrigerator size cable box anywhere on resident's property without municipal controls. The municipalities have been able to gain some controls—but there are issues about funding. and Channel 6. The Mayor noted State Representative Carolyn Krause worked hard to protect the municipalities. The motion is needed tonight because if the Village does not act before July I" there will be no protection for the Village's interests. ) Motion to direct the Department of Engineering and Community Development to review any permit application for installing facilities in a Village Right-of-Way consistent with the procedures and regulations currently under review, and to withhold the issuance of any permit until any amendatory Ordinance has been enacted by the Board. i MOVED: Trustee Lissner SECONDED: Trustee Czarnik AYES: Trustees Feichter, Lissner, Petri, Prochno, Czarnik, Dill NAYS: None ABSENT: None MOTION CARRIED I b. HEALTH & COMMUNITY SERVICES BOARD -TRUSTEE CZARNIK Trustee Czarnik said a few words in memory of Michael Tuozzo who passed away on June 9, 2007. Condolences were extended to Mr. Tuozzo's family. Mr. Tuozzo was appointed to the Community Service Committee in November of 2002 and will be greatly missed. I Farmer's Market will be held every Wednesday through September from 7:00 a.m. to 1:00 p.m. The Farmer's Market will be closed on Wednesday, July 4, 2007. Additional information can be obtained on the following web site www.eIkgroveparks.org/farmersmarket.asp. Trustee Czarnik announced the Master Gardener Program of the University of Illinois Extension Service would attend the Farmer's Market from 9:00 a.m. to Noon. j Community Services will sponsor a "Treasures and Trash Sale" at Elk Grove High School on Saturday, June 30, 2007, at from 9:00 a.m. to 3:00 p.m. The proceeds will benefit the Kenneth Young Center. Anyone interested in being a j vendor should call 847-357-4121 for an application and further information. The Elk Grove Spirit Award Committee is always looking for nominations. Residents can acknowledge someone's good deed by nominating a person or group for the Award. Nomination forms are available at the Village Hall, Library, Pavilion and Jarosch Bakery. 7 VBM 6-19-07 There will be a Prescription Drop Off event on Saturday; June 30, 2007 from 8:00 a.m. to Noon. The event will be held in the lower level of the Charles J. Zettek Municipal Building. Meeting Schedule—The next meeting of the Board of Health and Community Services will be held on Wednesday; June 20, 2007 at 7:00 p.m. in the lower level of the Zettek Municipal Building. C. LIQUOR COMMISSION - MAYOR JOHNSON No Report d. SPECIAL EVENTS COMMITTEE— MAYOR JOHNSON No Report e. O'HARE UPDATE —MAYOR JOHNSON Court cases are still pending f. BIKE RACE UPDATE —MAYOR JOHNSON The Mayor discussed the bike race during the Mayors Report. g. ADMINISTRATIVE/PUBLIC SAFETY COMPLEX CONSTRUCTION — MAYOR JOHNSON Construction is proceeding in a timely manner and the demolition of the current Police Building should take place prior to the July 17, 2007 Village Board meeting. It is anticipated that by the end of winter and/or early spring of 2009 all work will be completed. The Police Department will be relocated to 321 Bond Street as of July 14, 2007. A special newsletter will be sent to residents with information on the changes to entrances and new phone numbers. The new Municipal building will serve the needs of the community for many years to come in a more efficient and safer facility. 19. ORDINANCE, RESOLUTIONS AND COMMUNICATIONS —VILLAGE CLERK None 20. UNFINISHED BUSINESS Village Board— none Village Attorney—A Gaming Ordinance is currently being prepared and will be presented to the Board at a later date. 21. REPORT FROM THE VILLAGE MANAGER No Report j 22. NEW BUSINESS No Report AUDIENCE — 8:14 p.m. Leo Cox of 660 F. Versailles Circle and President of the Lake Cosman Townhome Association told of beautification and landscaping projects planned by the Townhouse Association. Mr. Cox's presentation to the Board included: (1). A request that Elk Grove Village assist with watering services for the new plantings on the three islands located on the Village streets within the Townhouse properties, (2). The Village consider a reduction of permit fees and tap.fees for the Town homes, (3). A request, following considerable discussion, that the Village consider taking over maintenance of all sidewalks within the Village. j 8 VBM 6-19-07 0 Mayor Johnson responded that the Village does not have an irrigation system nor do they water established plantings throughout the Village. He said Village staff would review the records to confirm whether the islands or courts on the Townhouse property are considered public or private property. The Mayor said it would not be appropriate for the Village to help with costs for private landscaping improvements. Mayor Johnson talked about fees saying that they are disbursed evenly between all residents. The Mayor talked about the private parking areas and street resurfacing needs of the Town home property. He noted Versailles had been resurfaced several years ago, and the Village had replaced curbs and sidewalks that were not a part of the private driveways. The Village's concrete replacement program offers homeowners replacement of private driveways and aprons. All residents must be treated equally. Marilyn Wilkerson; 342 Banbury; stated her opposition to OTB. Joe Meister; 920 Wisconsin Lane; recommended the Elk Grove Spirit Award be renamed to the Bart K. Dill Spirit Award. The Mayor announced this would be Trustee Dills last Village Board meeting as an elected official. Trustee Dill resigned effective June 29, 2007 after serving in local government for over 34 years. Trustee Dill held offices on the Park Board and Library Board as well as Village Trustee for the last 10 years. Each Village Trustee took this opportunity to extend their appreciation and best wishes to Trustee Dill in his retirement. The Trustees talked about their friendship with Trustee Dill throughout the years commenting it had been an honor to serve on the Board with him. Mayor Johnson said Trustee Dills retirement would be breaking a string of over ten years of the same Board members serving on a Board. The Mayor said that in 10 years this Board had approximately 215 Village Board meetings and talked about the "famil} relationship the Board I has. Mayor Johnson pointed out that for 34 years of Bart's life Bart served the community. No elected official in the Village's history has served the community for that length of time. Mayor Johnson issued a Proclamation honoring Village Trustee Bart K. Dill on his retirement and proclaiming June 19, 2007 as Bart K. Dill day in the Village of Elk Grove Village as an expression of gratitude for his outstanding service to the Village. i Trustee Dill introduced his family and announced that he and Terri had just celebrated their 52nd Wedding Anniversary the day before. Trustee Dill thanked the people of Elk Grove Village for their support. He spoke of the professionalism of Village staff and thanked them for their kindness and assistance. He talked about his 10 years as a Trustee and thanked the Board members noting his admiration for each. He talked about Mayor Johnson's leadership, devotion and passion for Elk Grove Village. Trustee Dill thanked his family and said he is a better person today because of their patience with him. 23.
