Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled
meeting of the Village President and Board of Trustees on June 16, 2009, this Executive Session
was called to consider a Litigation matter.

Litigation
The Village Board was advised of pending commercial waste franchise litigation. It was noted
that roll-off refuse carriers are suing select communities that have franchise agreements with
haulers that have lid containers. SWANCC has indicated that they will spend up to $100,000 to
defend the litigation from their existing funds. Although Elk Grove is not named in the lawsuit,
the implications of the decision could have a dramatic impact on the Village. The consensus was
to support SWANCC's legal action.
