HomeMy WebLinkAboutORDINANCE - 3561 - 6/28/2018 - DID NOT PASS ORDINANCE NO. 3561 ORDINANCE NOT PASSED AT THE 6-28-18 VILLAGE BOARD MEETING AND WILL BE UNDER REVIEW AT THE AUGUST 14, 2018 VILLAGE BOARD MEETING AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE AND REZONING SAME IN ACCORDANCE WITH THE VILLAGE’S COMPREHENSIVE PLAN AND ZONING MAP WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code (65 ILCS 5/7-1- 13), the Village of Elk Grove Village (“Village”) has the authority to annex property surrounded by the Village, which is less than 60 acres in size; and WHEREAS, pursuant to Section 7-1-13 of the Illinois Municipal Code, notice of the contemplated annexation was published in the Daily Herald, a newspaper of general circulation in the territory hereinafter described, on June 13, 2018; said date being at least ten (10) days prior to passage of this Ordinance; and WHEREAS, notice of the contemplated annexation also was sent by certified mail to each taxpayer of record in the territory hereinafter described on June 12, 2018; and WHEREAS, any land owner, township supervisor, township clerk, township board member, township highway commissioner, fire protection district, library district, corporate authority of Cook County or other entity or person entitled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, it is in the best interest of the Village of Elk Grove Village that said territory be annexed to and become part of the Village. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the findings set forth above are incorporated by reference into this Section 1 as if fully set forth herein. Section 2: That certain land and territory, which land and territory is less than sixty (60) acres in size and is wholly bounded by the Village of Elk Grove Village and another municipality, and is not within the limits of any other municipality, and legally described hereinafter in Section 3, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such case made and provided. Section 6: That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this ordinance together with a plat of annexation of said territory, as appended hereto, with the Recorder of Deeds of Cook County Illinois. Section 7: That the Village Clerk is hereby directed to file with the County Clerk and the Cook County Election Department a certified copy of this ordinance together with a plat of annexation of said territory, as appended hereto, and to report the annexation of the territory to the proper postal service officials. Section 8: That the Village Clerk is directed to amend the official Village map in accordance with the provisions of this ordinance. Section 9: That the Village Clerk is authorized to publish this ordinance in pamphlet form.
