AN ORDINANCE APPROVING THE PLAT OF RESUBDIVISION IDENTIFIED AS ELK
GROVE TOWN CENTER SUBDIVISION (910 BIESTERFIELD)
WHEREAS, the Plan Commission of the Village of Elk Grove Village at a Public
Hearing, duly called and held according to law, considered a petition to resubdivide the Town
Center located at 910 Biesterfield Road from one lot to four lots with related variations with regard
to various zoning regulations; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after
having reviewed the recommendation of said Plan Commission, find and believe it to be in the best
interest of the Village to grant approval of said resubdivision and the recommended conditions and
variations associated therewith;
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That the Plat of Subdivision identified as the Elk Grove Town Center
Subdivision, a copy of which is attached hereto and incorporated herein be and the same is hereby
approved, subject to the condition that Brixmor Holdings 1 SPE, LLC execute a Repair,
Maintenance and Escrow Agreement with the Village and make the required One Hundred
Thousand Dollars ($100,000) security deposit with Near North National Title LLC.
Section 2: That the Special Location Parking Plan to allow parking for lots 3 and 4 to use
the common parking areas in lot 1 is hereby approved.
Section 3: That there be granted the following variations of the Zoning Ordinance:
a. A variation of Sections 713-5-3:13 and 713-5-3:1) to permit no front yard setback for lots 3
and 4.
b. A variation of Section 7B-5-3:A which requires a ten (10) acre minimum lot size for B-5
zoned properties to allow lot 2 to be 1.43 acres, lot 3 to be 1.61 acres, and lot 4 to be 0.46
acres.
c. A variation of Section 7B-5-3:C which requires five (5) parking stalls per each 1,000
square feet of gross floor area to permit zero parking stalls on lots 3 and 4.
d. A variation of Section 713-5-3:1) to permit ground coverage of 22.5% on lot 2, 93% on lot
3, and 96% on lot 4 which exceed the 20% maximum ground coverage requirement.
e. A variation of Section 713-5-3:1) which requires a minimum front yard lot width of 150 feet
to permit a front yard lot width of 93.49 feet for lot 4.
f. A variation of Section 713-5-3:1) which establishes a maximum floor area ratio of .2 to
permit a floor area ratio of .225 for lot 2, 0.93 for lot 3, and 0.96 for lot 4.
g. A variation of Sections 4-4-1 and 713-5-5 to permit zero designated loading spaces for lot 4.
h. Variation to waive the required rear easements for lots 3 and 4.
Section 4: That there be granted a variation of Section 8-1213-1-11) of the Elk Grove
Village Code to waive the required rear easements for lots 3 and 4.
Section 5: That this ordinance shall be in full force and effect from and after its passage
and approval according to law.
