HomeMy WebLinkAboutORDINANCE - 3564 - 7/17/2018 - 901 Meacham resubdivision - McDonaldsORDINANCE NO.3564 AN ORDINANCE APPROVING THE PLAT OF RESUBDIVISION IDENTIFIED AS THE FINAL PLAT OF SUBDIVISION — MALLARD CROSSING SHOPPING CENTER AND GRANTING A SPECIAL USE TO OPERATE A DRIVE-THRU FACILITY 901 MEACHAM ROAD) WHEREAS, the Plan Commission of the Village of Elk Grove Village at a Public Hearing, duly called and held according to law, considered a petition to resubdivide the Mallard Crossing Shopping Center Subdivision located at 901 Meacham Road subject to various conditions and a petition to grant a Special Use Permit for a Drive-Thru Facility; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation of said Plan Commission, find and believe it to be in the best interest of the Village to grant approval of said resubdivision and the recommended conditions associated therewith and to grant the requested Special Use Permit for the Drive- Thru Facility. NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the Plat of Subdivision identified as the Mallard Crossing Shopping Center, a copy of which is attached hereto and incorporated herein, be and the same is hereby approved, subject to the following conditions: 1. Sanitary sewer agreements, storm sewer agreements, and cross access easements for proposed lots 1 and 2 must be approved by Village Staff. 2. A revised parking site plan must be approved by Village Staff with parking spaces in the rear reconfigured to allow for the maximum number of spots while meeting the 19' minimum length required by code. Section 2: That there is hereby granted a Special Use Permit to permit a Drive-Thru Facility on lot 2, subject to the following conditions: 1. The Petitioner shall terminate any lease or interest in the property at 633 Meacham Road within 60 days of the issuance of a certificate of occupancy for their new location at 901 Meacham Road. 2. The Petitioner must submit a final landscape plan for review and approval by the Plan Commission. Section 3: A variation of the previously approved shopping parking site plan of 402 stalls be granted to allow a new parking site plan with a minimum of 327 stalls — 313 stalls in the front parking area and a minimum of 14 stalls for employee parking behind the shopping center. Section 4: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 4 NAYS: 0 ABSENT:2 PASSED this 171h day of July 2018.
