CONSENT AGENDA A) To authorize the Plan Commission to hold a public hearing on the petition of Office Depot for a Special Use Permit to construct a retail shopping center in a. I-2 zoning district located at the southeast corner of Devon and Busse. (Office Depot is proposing to build a 59,370 square foot retail center on the 8. 12 acre site. This use requires a special use permit in the 1-2 zoning district . (A public hearing date has not been established. ) B) Consideration of the following: -- To approve the Balancing Change Order for the Eden Road Watermain Project for a net decrease of $578.50; and -- To approve the Final Pay Estimate of $20,206. 50 for this project. (The Village Board awarded the Eden Road Watermain Project contract to John Neri Construction on July 26. The project is complete and has been reviewed and approved by the Engineering and Community Development Department . Agenda for VBoReeting 9-13-94 -2- (The project was completed at a total cost of $20,206.50, which is 2 . 8% below the contractor 's bid price of $20, 785. (A report from the Director of Engineering and Community Development Department recommending approval is attached. ) C) Consideration to award a purchase contract to the lowest responsive and responsible bidder to furnish and install 300 parkway trees. (The bid opening for this contract is on September 8. Details on this contract will be provided prior to the September 13 Village Board meeting. D) Consideration to adopt RESOLUTION NO. 47-94 (attached) authorizing the Village President to execute an agreement between the Village of Elk Grove Village and the Suburban Bus Division (PACE) of the Regional Transportation Authority (Dial-A-Ride) . (The proposed agreement will provide Dial-A-Ride service retroactive to August 15, 1994 through August 14, 1995. The agreement contains the same terms and conditions as our current agreement; however, the hourly bus operating rate is increasing 8% over last year from $23.95 an hour to $25.90 an hour. The large increase was a result of PACE rebidding the contract for a 3-year period. The old rate was accepted as a low bid over 3 years ago. (This increase could result in the expenditure of $11 ,000 more for the service over last year, depending upon ridership. Based upon current ridership figures, the cost for the service will be $71 ,500 per year. This increase was expected and planned in the budget . Sufficient funds are budgeted and available for this expenditure. (A report from the Administrative Assistant is attached. ) E) Consideration to adopt RESOLUTION NO. 48-94 adopting the Village of Elk Grove Smoking Policy (attached) and rescinding Resolution No. 6-93, the Village 's former smoking policy. (The Smoking Policy was amended to prohibit smoking in all municipal facilities. (This item was discussed at the August 23, 1994 Committee of the Whole Meeting. ) F) Consideration to adopt Ordinance No. 2388 (attached) amending the Village Code of the Village of Elk Grove Village, Section 6-4-5-3, Prohibited and Restricted areas (Bonaventure) . Agenda for VB*eeting 9-13-94 0 -3- (Currently trucks are parking along both sides of Bonaventure and, therefore, reducing the roadway width for passing traffic. This commercial roadway is too narrow for emergency equipment to pass when there are trucks parking on both sides of the street . The ordinance solves this problem by prohibiting parking on the south side of Bonaventure. Pending Action by Village Attorney: At the August 23, 1994 Village Board meeting the Attorney was .directed to prepare an ordinance granting a variation to permit the parking of a recreational vehicle that would encroach into the required six foot distance between the structures and lot line at 1591 Oregon Trail . 16. CONSENT AGENDA C) Consideration of the following: -- To award a purchase contract to the lowest responsive and responsible bidder, St . Aubin and Brothers, Inc. , Kirkland, IL, to furnish and plant three hundred (300) balled and burlapped deciduous shade trees in an amount not to exceed $139 . 70 per tree, and not to exceed a total amount of $20, 676 from the General Fund and $21 ,235 from the Capital Projects Fund; and, -- To increase the Capital Projects Fund budget by $21,235 for the purchase of 152 additional trees , scheduled for planting along Meacham Road. (St . Aubin 's prices are 21% less than last year's prices on maple and ash trees and 12% less than last year 's prices on oak trees. (Of the 300 trees to be purchased, 152 of those trees will be planted along Meacham Road. Since the decision to plant those trees was made after the finalization of the budget, a budget increase is necessary, in the Capital Projects Fund, to cover this expenditure. (In addition, the Village budgeted $30,000 in the General Fund for the purchase of 148 trees throughout the Village. Due to the low pricing, the Village will only be expending $20, 676 of that amount. (St . Aubin & Brothers has agreed to participate in the Village 's Residential Tree Planting Program under the terms and conditions in the village 's contract . The residents ' cost will be $159. 70 per tree, tax included. All orders and payments will be exchanged between St . Aubin and the resident. The cost to residents for private trees this year is 30% less than last year ($230) .
