Call to Order 2 . Invocation (Rev. Rodney L. Pickett, Pastor) Wesleyan Community Church 3. Approval of Minutes of August 9, 1994 . 4 . President 's Report 5. Accounts Payable Warrant : August 23, 1994 6. CONSENT AGENDA A) Consideration to grant a request (attached) from William and Donna Bergman, 403 Laurel Street, for a fence variation to allow the finished side of their fence to face their property. (The Bergmans recently installed 45 feet of six foot fence along the east side of their property with the finishe&.. 'side facing their property. The Village requires the finished side of the fence to face away from their property. At the time, the Bergmans were unaware of the need for a permit and have since applied for the necessary permit . (When the fence was installed an existing chainlink fence prevented the finished side from facing out due to its close proximity. in addition, the new fence faces the same direction as the remainder of the fence previously installed providing for continuity and an aesthetic appearance. (Property owners adjacent to the fence have written a letter (attached) indicating their support of the fence. (A report from the Director of Engineering and Community Development, granting approval , is attached. ) Agenda for VB Peting 8-23-94 -2- B) Consideration to authorize the Plan Commission to hold a public hearing on the petition of Ameritech for a Special Use Permit to construct a monopole communications tower and related equipment shed at 952 Fargo Avenue. (A public hearing date has not been established. ) C) Consideration of a request (attached) from M & M Industries, 1600 Pratt Boulevard to hold a warehouse sale on Friday, August 26 from noon to 6 p.m. and Saturday, August 27 from 10 a .m. to 4 p.m. (All activities will take place within the building and customers will utilize the existing parking lot . No problems are anticipated with this event . (A report from the Director of Engineering and Community Development recommending approval is attached. ) D) Consideration of a request (attached) from Nancy Gunderson to hold an outdoor garage sale at 2301 Estes (Puskar Precision Machining Company) on Saturday, August 27, from 11 :00 a.m. to 4 :00 p.m. (Ms. Gunderson represents a liquidation company that buys and sells used furniture, clothing, and household items. A portion of the profits will be donated to the Bosnian Relief Effort . The owner of this property has granted his approval for the sale. (It is not anticipated . that this event will create any parking problems. (A report from Director of Engineering and Community Development, recommending approval, is attached. ) E) Consideration to award a professional service contract to Rust E & I, Inc. , Schaumburg, IL for construction phase engineering services for the west zone water tower on a cost plus fixed fee basis for an amount not to exceed $26,500. (On August 9, 1994, the Village Board awarded a contract to CBI Na-Con, Inc. , to construct the water tower. Construction engineering and inspection services are necessary to ensure that the tower is built properly. A proposal for these services was solicited from Rust E & I and service and compensation terms were negotiated. (Rust E & I was involved in determining theneed and location for the tower. Rust E & I also designed the plans for the tower to meet the requirements of our water system. For these reasons Rust E & I is Agenda for VB Peting 8-23-94 -3- most familiar with the project and is recommended for this work. (Sufficient funds are budgeted and available for this expenditure. (A report from the Director of Public Works, recommending approval, is attached. ) F) To authorize payment of $1 ,212 . 75 in dues to the Illinois Municipal League for Fiscal Year 1994-1995 : (The dues amount reflects no change from last year 's dues payment . (The Illinois Municipal League (IML) represents municipalities on legislation pending before the, General Assembly. In addition, our dues payment includes subscriptions to the Illinois Municipal Review which is a monthly publication that contains information on programs and activities of other municipalities. (Sufficient funds are budgeted and available for this expense. ) G) Consideration to authorize payment to Police Consultants (PCI Fire Division) in an amount not to exceed $11 ,210 for the group testing of firefighters ' applicants on behalf of the Fire and Police Commission . (The $11 ,210 fee is for firefighter applicant testing held on July 24, 1994 . (Sufficient funds are budgeted and available for this expenditure. ) H) Consideration to authorize the Health Coordinator to attend the American Public Health Association Conference, to be held in Washington, D.C. , October 29 through November 3, 1994, at a cost not to exceed $1 ,254 . (By registering now, the Village will save $25 in early registration fees. (Sufficient funds are budgeted and available for this expenditure. ) I) Consideration of the following; -- To approve the Balancing Change Order for the drainage ditch enclosure project for a net increase of $11 ,259 . 15 from the contract price; and -- To approve the final pay estimate to Lo Verde Construction Company, Inc. , Wheeling, IL, for the Reverend Morrison/Elk Grove Boulevard drainage ditch enclosure project in the amount of $2,895,970. 15 . Agenda for VB Oeting 8-23-94 0 -4- (The Village Board awarded the contract to Lo Verde Construction Company, Inc. , on November 24 , 1992 for the drainage ditch enclosure project which included the installation and enclosure of sanitary sewer along Reverend Morrison and Elk Grove Boulevard. (Lo Verde completed the project at a total cost of $2, 895 . 970. 15, which is $11 ,259 . 15 above the contract price. In conjunction with the Ditch Enclosure Project, new sanitary sewer forcemain was installed by Mola Construction along Elk Grove Boulevard. Lo Verde performed the pavement restoration for this project, thereby increasing the total cost of that contract, but decreasing by more the cost of the Mola contract . Lo Verde replaced the pavement instead of Mola Construction so that the Village could take advantage of Lo Verde 's lower prices. (A report from the Director of Engineering and Community Development, recommending approval is attached. ) J) Consideration to adopt RESOLUTION NO. 45-94 (attached) to postpone acceptance of Continental Cablevision of Northern Cook County's Basic Tier Cable Rates (FCC Form 1220) . (The Village received new rate regulation forms from Continental Cable as required by the FCC. The Cable Group's Accountant is still in the process of reviewing previous rate forms submitted. by Continental justifying their basic tier rates. (This resolution tolls the effective date of the rate forms for up to 150 days. This will allow enough time to have our accountant complete the review of the first forms before making a decision on the reasonableness of the new forms. ) K) Consideration to adopt RESOLUTION NO. 46-94 (attached) authorizing the Village President to execute an agreement between the Village of Elk Grove Village and Triton Consulting Engineers, LTD. , to provide construction services for intersection improvements at Biesterfield Road and Arlington Heights Road at a cost not to exceed $177, 690. (The agreement provides for Triton Consulting Engineers, Ltd. , to perform construction services for the intersection improvements on Biesterfield Road and Arlington Heights Road. (Triton will perform daily inspections of the construction work, construction staking and layout for alignment, coordinate material testing, prepare all records and review pay estimates, and coordinate construction with area businesses and residents. (Triton designed the roadway improvement plans Agenda for VB Joeting 8-23-94 • for this project and has the necessary knowledge and experience to complete the work. (Staff has reviewed the agreement and finds it acceptable. The contract cost ($177, 690) is 9. 35% of the estimated total construction cost . (A report from the Director of Engineering and Community Development, recommending approval , is attached. ) L) Consideration to adopt ORDINANCE No. 2387 (attached) providing for a general advisory referendum regarding local versus State spending decisions on community services. (At the August 8, 1994 Committee of the Whole meeting it was the consensus of the Board to support the referendum question submitted by the Suburban Mayors Action Coalition.
