Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the
hearing notification procedure as well as the legal notice. The petitioners, Kenneth Sack of
Watermark Engineering, Christy Carson representing McDonalds, and Rich O'Keefe
representing the property owner were sworn in and asked to present their case.
Mr. Sack stated that the reason for the requested variation was due to the extensive site and
building modifications taking place at the McDonalds facility. The existing trash corral needed to
be relocated farther to the south of the property due to the installation of a double drive through
lane along with a passing lane. Mr. Sack noted that the new trash enclosure will be a brick
structure matching the new brick fagade of the McDonalds facility. Mr. Sack stated that the
current shrubbery near the trash conal will provide additional screening and this was the
preferred location of the trash corral based upon aesthetics and no issues regarding vehicular
sight lines.
Mr. Childress opened the meeting to questions from the board.
Ms. De Frenza asked the petitioners if any additional landscaping was proposed around the trash
corral.
Mr. Sack stated that landscaping was proposed to the north of the trash corral.
Mr. Bookler asked the petitioner the height of the trash corral.
Mr. Sack stated the trash corral would be approximately six feet(6') tall with a stone cap on the
top.
Mr. Rettberg asked the petitioners why construction had already started on the trash corral prior
to an approval of the variation request.
Mr. O'Keefe stated that due to the tight construction schedule of the project and the long lead
period to receive all the easement waivers, constriction of the foundation and pad system for the
trash conal was necessary to move the project forward. Mr. O'Keefe made reference to a letter
he sent the Village stating "McDonalds was proceeding with the trash conal foundation work at
their own risk and would remove the foundation system if the variation request was not
approved."
Mr. Rettberg asked the petitioners why the trash corral needed to be in this location on the site.
Mr. O'Keefe stated the need for the additional drive through lane forced the existing trash corral
to be demolished and the new trash corral to be located further south on the property to
accommodate all the required driving lane widths and vehicular access around the site.
Mr. Zinnel asked the petitioner to state their hardship for the variation request.
Mr. O'Keefe stated the drive through accommodates approximately seventy five percent (75%)
to eighty percent (80%) of their business and the double drive through is necessary to provide
adequate service to their customers. The need for the double drive through lane resulted in
relocating the existing trash conal further to the south on the property.
Mr. Dohrer asked if any landscaping was proposed on the south side of the trash conal.
Mr. O'Keefe stated there is existing landscaping; however they would install additional
landscaping if requested by the zoning board to further shield the trash conal.
Mr. Rettberg asked the petitioners if they had a second location for the trash conal if the
variation was not approved.
Mr. O'Keefe stated that due to the limitations to the site, this was the most feasible location for
the trash conal. This location would be the least intrusive and the most accommodating to the
design and functionally of the site.
Ms. De Frenza asked the petitioner how often garbage was picked up at the site and if they ever
had any issues with smell/rodents due to the garbage.
Mr. O'Keefe stated garbage was picked up twice a week and they have never had any issues with
the Smell of garbage at the site.
Mr. Childress then asked if there was anyone from the public who would like to speak. No one
in attendance had any objections or statements.
A motion to grant a variation to permit the construction of a trash corral extending approximately
seventeen feet (17') into the required twenty five foot (25') front yard setback was made by Mr.
Dohrer , contingent upon receiving a landscaping plan for additional shrubbery along the south
of the trash corral, and was seconded by Mr. Carlson. Upon voting (AYES —Childress,
Bookler, De Frenza, Colgan, and Zinnel) (NAYES- Rettberg) the motion to grant the
variance passed. Mr. Childress advised the petitioners to contact the Village Clerk and attend
the subsequent Village Board Meeting. The meeting adjourned at 7:35 p.m.
