Zinnel J. Meister, Sr. R. De Frenza S. Carlson Absent: M.Colgan P. Rettberg Staff: J. Polony,Plan Review Supervisor, Community Development Zoning Variation —Docket# 13-3 208 Fern Drive Chairman Childress called the meeting to order at 7:30 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Beth Stiff, was swom in and asked to present her case. Ms. Stiff stated that she currently has a fence which extends approximately nine (9) feet in front of the adjacent neighbors nearest front comer of the principal building. Ms. Stiff stated the existing fence is in need of repair and she would like to extend the fence further past its current location to provide more space within her enclosed backyard. She stated the extension of the fence would permit more room for her grandchildren and dogs to play. Mr. Childress opened the meeting to questions from the board. Mr.Bookler stated that he had line of sight concerns if the fence was extended further than its current location. Ms. Stiff stated she would be willing to replace the fence in its current location; however since she had to go through the variation process to replace her existing fence, she wanted to request an extension of the existing fence. Multiple members of the Zoning Board stated their line of sight concerns related to the extension of the existing fence. 1 Ms. De Frenza asked the petitioner how long she lived in the house and if she had installed the existing fence. 1 i Ms. Stiff stated she has lived in the house for approximately fourteen(14) years and she installed the fence when she moved in. Mr. Dohrer asked the petitioner the intended style and height of the proposed fence. Ms. Stiff stated the new fence would be a five (5) foot high, privacy fence. She also mentioned the existing fence is currently five (5) feet in height. Mr. Childress opened the meeting to questions from the public. Dianna Wilson, 221 Clearmont Drive, stated her concerns about extending the fence further than its current location. Ms. Wilson stated she currently has line of sight issues when backing out of her driveway and if the fence was extended it would greatly impact the safety of pedestrians traveling along the sidewalk. Additionally, she stated she was not opposed to the fence being replaced in its current location or being extended a minimal distance further. A motion to grant a variation for the construction of a five (5) foot high, privacy fence which would extend approximately nine (9) feet beyond a line extended from the nearest front corner of the principal building located on an adjacent single-family residential lot was made by Mr. Meister, contingent upon the proposed fence being replaced in the exact location of the current fence, and seconded by Mr. Carlson. Upon voting (AYES—Childress,Bookler,De Frenza, Zinnel and Dohrer.) The motion to grant the variance passed unanimously. Mr. Childress advised the petitioner,Ms. Stiff, to contact the Village Clerk and attend the subsequent Village Board Meeting. The meeting adjourned at 7:50 p.m. Respectfully submitted, l >Jaed Po Plan Review Supervisor, Community Development C: Chairman and Members Zoning Boards of Appeals,Mayor and Board of Trustees, Village Clerk, Village Attorney, Village Manager, Deputy Village Manager, Assistant to the Village Manager, Director of the Engineering and Community Development, Director of Public Works, Fire Chief, Deputy Fire Chief(2), Inspectional Services Supervisor, Chairman and Members of Plan Commission
