Polony, Plan Review Supervisor, Community Development Zoning Variation—Docket# 13-5 1117 Somerset Lane Chairman Childress called the meeting to order at 7:00 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Darlene Pontrelli,was sworn in and asked to present her case. Ms. Pontrelli stated the reason for the variation request was to fence in the backyard to provide protection for her grandchildren to safely play. She has three (3) grandchildren, ages 3, 7, and 15, that are temporarily living with her and feels the fence will help protect them from vehicular traffic along the busy roadways.Additionally,her 3 year grandson is a special needs child and needs to be restricted from entering adjacent yards or wondering into the roadways. Mr. Childress opened the meeting to questions from the board. Ms. De Frenza asked the petitioner to state her hardship for the variation request. Ms.Pontrelli stated the primary reason for the variation request was to provide a barrier in her back yard so her grandchildren have a safe place to play. Mr. Rettberg asked the petitioner how long her grandchildren will be living at her house. Ms. Pontrelli stated her grandchildren will be living with her for approximately one(1) year; however she babysits her three(3) year old grandson throughout the school year. Mr. Dohrer suggested configuring the fence at a different angle to limit any sightline issues with the neighbors at 192 Brandywine. The suggested location would push the fence back to the west approximately three to four feet. Mr. Dohrer felt the currently proposed location of the fence would impede the neighbors' sightlines if looking out their front window. Ms. Pontrelli agreed to configure the fence as requested by Mr. Doluer. Mr. Childress opened the meeting to questions from the public. Mark Lesniak, 192 Brandywine Avenue, stated he has no objections to the placement or height of the proposed fence. He feels based upon the configuration and uniqueness of Ms. Pontrelli's lot, the proposed fence location is in the most feasible position. He does not feel like the fence will limit the enjoyment of his yard or diminish his property value. Tim Bums,217 Wellington Avenue,stated he recommends the approval of the variation request. Since he has moved into his house,he has seen two (2)vehicular accidents at the street intersection which resulted with vehicles encroaching onto Ms. Pontrelli's property and feels the fence is essential for protection of the her grandchildren. A motion to grant a variation for the construction of a four(4) foot high, vinyl fence which would extend approximately thirty six(36)feet beyond a line extended from the nearest front corner of the principal building located on an adjacent single-family residential lot was made by Mr. Dohrer, contingent upon the proposed fence, parallel to Brandywine Avenue, being placed in the amended location as shown on the attached Google Site image, and seconded by Mr. Rettberg. Upon voting(AYES—Childress,De Frenza,Zinnel and Carlson.)The motion to grant the variance passed unanimously.Mr. Childress advised the petitioner,Ms. Pontrelli,to contact the Village Clerk and attend the subsequent Village Board Meeting.
